I think this was mis-selling.
Its not if it was a requirement of the lending.Question: - does the fact we got some benefit from the PPI negate any claim?

the cold calls are liars. They'll say anything to get some business whether it's a viable missale or not.

I reclaimed PPI on a mortgage I had with Barclays bank. This mortgage started 1990 and ended 2005 when I sold the property. My bank acknowledges I was miss-sold the policy (and quotes the policy number in their response) however, they tell me that as the sale of the policy was so long ago they no longer have records of the premiums paid. They are offering me a goodwill payment of £500 and say they will re-calculate if I can provide 'any records that will give them the information they need to calculate an accurate offer'. I do not have any paperwork but I have been with the same bank who granted this mortgage for over 40 years....as this is an ongoing account and they have found the policy then surely they should have records of the premiums I paid. How should I move forwards with this? I realise that I am technically out of time but my accounts with this bank are still live?0

You are talking about an event 22 years ago. It's not unreasonable for them to have destroyed their records, after all, you have.

over 12 months ago i tried to use this company to claim on my behalf after 12 months of paper work signing forms n the like phone calls every 2 week untill BANG i phone the usual way give me all the speil name postcode u call is recorded bla bla to be told CARCRAFT have not recived my paperwork again she then told me ill get on to them now i waited 10 minutes. to be told ill send the case again by recorded dillivery ok i said not happy but will wait. after 12 months of waiting another few weeks wont hurt fot to be told 5 mins after by phone call from PPICLAIMBACK that thay no longer wish to persue my case as carcraf are rubish at comunicating is this legal ?
ps is like to tell all never use these companys there awful

You are getting lucky. Most other places would refuse your complaint as no evidence exists. Firms are required to destroy data no longer required. The FSA recommend 6 years for holding data. So, no, they should not hold the data.

Had a loan with A & L around 2007. The only evidence I had was the amount and a rough date from an old bank statement. I didn't have actual PPI but I remember the "salesman" on the telephone pushing some kind of cover. I recall telling him that I get generous sick pay from my job (6 months full pay/ 6 months half pay!).
So I rang Santander PPI reclaims on 27th November. The woman on the phone found the details quite quickly, took my application and said I'd hear with 6 weeks. 6 DAYS later I had a letter offering me £182 in full and final payment !!! They refunded the premiums and paid interest. I accepted (obviously!) and the money went in the bank on the 7th December. Thats 11 days start to finish.
I would URGE people to apply. No solicitors needed- just call the lender. Be firm. :j0 -
A company contacted me asking about PPI, I said I had no idea so they sent a load of forms and sent them off to Northern Rock whom I have a mortgage with. They replied and said I had a claim and I would hear from them. That was end of Sep, I called them and they said they have not heard back from NR. Now I realise I can claim myself so could I just contact NR myself and get things started as they initially said 8 weeks which it has been a lot longer now, or am I now tied this claim company?0
