    I just filled in the leaflet and ticked the boxes for PPI. I cancelled the PPI in 2006 on one card and in 2010 on the other. I still use the cards currently. Can I reclaim the PPI insurance as due to them nor checking the cover was suitable for me and didn't make me aware other products were available?

    1- there is and never has been any requirement to tell you that other products/providers are available.
    2 - you chose to buy it. It was not mis-sold
    I also had 2 flexiloans and 2 loans with HSBC in the late eighties to 90's. I have the account numbers which I gained by ringing up HSBC. Again I filled in the leaflet and ticked the PPI box when applying. Can I still claim back the PPI due to the same reasons as above??

    you have not indicated any reasons for mis-selling. So, on that basis, no.

    There is no such requirement to discuss other products. Also this is a non-advised sale, so there is no suitability check required.
  • Banks & credit card providers immediately apply interest charges to overdue accounts - since they have "borrowed" our money via their PPI charges, can/should WE charge THEM interest when making our claims?
  • So I made a Subject Access Request to Santander as I no longer have my account details for the Credit Card I took out in 2007 and settled in 2009. They have replied to me saying they do not hold historical records for this account. I thought by law they were required to retain these files for a certain length of time?

    How can I proceed reclaiming my PPI from Santander if they cannot or will not provide me with the information I have requested as I believe I need the account number and terms and conditions before I try to make a claim?

    you need the credit card number and the reasons for missale. It wouldn't hurt if you had your own statements too.

    there is no such law. However, there is a law requiring them to destroy documentation and records no longer required.

    im at abit of a loss as to were to direct my claim (if i even have one)
    when i took out my morgage in 2007 my mortgage advisor told me i needed ppi and set me up with a company called centrepoint, now the company who sorted out the mortgage have gone bust and centre point have been taken over by assurant which is who im still paying it to. i still have the original "key facts" about the mortgage and it doest mention the ppi
    any advice would be great

  • i just received a response from a lender who explained that my ppi complaint is 'time barred'. this is because 3 years had passed since the date of their original letter of 17/02/09 in which they wrote to me to give me the opportunity to decide whether or not i had any concerns over the way in which my ppi was sold. is it worthwhile going to the ombudsman about this?

    FSA rules mean you have 6 years from the purchase of the product or 3 years from being aware that there may be an issue to make a complaint. It appears you were notified in Feb 09. Therefore a timebar does seem reasonable in this case.
