my husbands bank said although he did not opt for PPI it was actually added but he had chances every month to cancel it when he saw it on his monthly statement so they said They wont refund the PPI. The account is now closed. What can he do

You can complain to the Financial Ombudsman Service.

However, a firm can object to it considering the complaint if:

    1) It is more than six years since the events to which the complaint relates.
    2) More than three years since you became aware, or ought reasonably to have become aware, that you had cause for complaint.

I would hazard a guess that they are applying this timebar.

I would be interested to know if FOS will allow them to do so.

I have an overdraft of £2000 which I am constantly up to the limit and often over that :( I recently spoke to my bank who agreed to stop charges- which they havent. Although I did recieve a letter stating my loan guard agreement has ended. Can I reclaim PPI on my overdraft??

If you never used the card, you won't have paid any PPI (which for credit cards is based on the amount outstanding). So the answer is a resounding no.

So you have never paid a penny but think you can get compensation?

I took out a mortgage with a company in 2003. I left them in 2005. That company has since been taken over by one company, who have referred me to a second company (the actual broker firm) who have told me their Mortgage arm was wound up some time ago. Neither of them are interested in looking at my PPI claim. Luckily, I have the original paperwork and sent copies to them both. If they both continue to fob me off what would be the next step? Should I email the CEO's for both companies (they have no idea I have their bosses email addresses) or go straight to the Financial Ombudsman or, email the respective CEO's first by way of obtaining a final response from the appropriate authorities for both before contacting the Ombudsman? Thanks.

If you used a broker and it was 2003 and that broker no longer exists then you have no-one to complain to. Regulation didnt start until 2005. The FOS cant look at cases where the seller no longer exists and the FSCS only look at cases that were taken out after regulation started.

The lender has no liability for the advice given by the broker.

  • I took a loan agreement with Endeavour personal finance approx 6 years ago. I found the loan agreement number and wrote to EPF requesting details of the loan agreement. They have replied to say that the bank is not required to provide information under 77/78 of the Consumer Credit Act 1974 when a loan agreement is paid in full. My account closed on 25 March 2008.

Does this mean the door is closed?

No. It means you cant request the agreement under the CCA. You dont need the agreement to make a complaint. That is just an internet myth.
