Hi, sorry to jump onto this post, just had a quick question...I recently had a claim upheld with Mbna, I have another claim that went in at the same time is it likely that if one was upheld the 2nd one will be too.
Is it the same bank with the same complaint reasons? Probably will be if so but each one is unique so no guarantee. If it's a different bank or same bank but different selling period, who knowsI was sent a questionnaire for the one that's been upheld but I didn't fill it in as I was told that it was them that needed to prove that I needed it not for me to prove I didn't ( by a friend in the industry).
Your friend is misguided. Miss-selling is done on the "he who asserts must prove" basis, that is to say you must prove it was miss-sold, not they prove it was not, that is how English law works. The questionnaire may have helped your case by providing them with additional information to help the complaint. Refusing to fill it in will at best have no effect on your complaint, at worst, would harm it as they would have to go only on the info you initially provided and you may not have mentioned everything that could help your cause.This claim was upheld but I've not had a request to fill in a questionnaire for the other claim that went in at the same time, which should be a much larger refund, do you guys think it won't be upheld or that they are just taking longer to calculate the refund
Depends on the value of the first, it might have been under the banks auto-pay limit so was a simple payout rather than fight it (often under £1000). As it sounds like you had 2 cards with them they're probably dealing with them together. As you didn't fill the form in the first time they might just be dealing with the info you already provided and nothing more. How it goes is not predictable.
��Also the one that's been upheld is for an account that's not been used in a while it is still open though. Will the refund be by cheque or does it get pain into the bank where they used to take the direct debit from?

Thanks very much for the reply, the first payout was less than the £1000 yes,:D but still enough to clear my post xmas overdraft!! will let you know when the reply comes about the other one...im also awaiting replies from a halifax credit card and a dorothy perkins store card.

Hi can anyone help:)
im at the start of investigating what ppi i may have paid. Ive found my closed loan account details on my experian report but there is no account number, only the dates of loan and amount of monthly payment etc.
The mse template letters to ask for details of old agreements seem to need an account number. Can i hope to get them to provide what i need without an account number, just name address and dates etc...??

I have been contacted by Barclays Bank regarding PPI that I had on my Barclaycard account, and I think Monument card which was part of Barclays at the same time. The letter has been sent to me as they have been trying to trace me for some time and have spent a lot of effort trying to find me over the last couple of years.
When I called the number on the letter the call representative said I needed to take two forms of ID down to my local Barclays and then they would call their office and then the case would be activated, there must be some significant reason why they feel the need they have had to chase me for such a long time has anyone got any thoughts on this?
I did have a Barclaycard with £5000 on going on it and yes I did have PPI and the monthly repayments were extortionate which ended up putting me into significant debt which was very stressful for myself and my family at the time.
The same scenario with the monument card as well which if i remember was about £2000, in the end I was paying many hundreds of pounds each month in interest and the amount owing was never really moving each month, to the point that I nearly had a breakdown because of it.
Does anyone have any ideas as to what to expect when I do hear back from Barclays with regards to this issue?

They're investigating it to see if you were miss-sold or not. There is no guarantee you will get a refund, they just need to clear their backlog and it allows them to time bar old complaints.
You need to separate card interest (which is a perfectly legitimate charge) from PPI. PPI was typically around 70p per £100 of debt. £5000 of CC debt would only have a PPI charge of £35 but even at a 10% APR you would have been accruing £500 of interest every month so you can see the PPI was peanuts in the scheme of things. Paying the minimum will always result in the balance going down slowly.
All you can do is present the forms of ID and they will investigate. I'd expect you would get a PPI form soon after where you can explain why you feel it was miss-sold and what evidence you can present.

I have literally just logged onto this site so apologies if I am commenting/posting in the wrong area!!
My query is this - a few years ago (over 10 years to be specific) me and my then partner took out a secured loan for over £25k. The loan did contain PPI.
me and my partner split up a few years ago and I would like to know if I (as an individual) can claim the PPI on behalf of myself?
