    You are still able to complain. However, logic is applied and you dont get a refund for something you didnt end up paying for.

    if your complaint is successful, they can use the redress payment against debt you failed to repay.

  • I wrote to the Clydesdale bank requesting information on any loans which had ppi they replied saying I had one credit card & 3 loans (no dates given ) but were "unable to determine if PPI was sold on these accounts, I'm unsure why they wouldn't have this information, I don't have any information either , what do I do now ?

    If you have no info and they have no info, then its game over.

    Data is required to be destroyed over time. The FCA recommend 6 years although many will hold for 10 or more years. Some data is destroyed progressively and not all at once. So, bits of the records may be removed at different points.

    If you dont believe them then you can spend £10 on a data subject access request.

    Hi Everyone,

    I did try years ago to have a go at ppi but never heard anything back, so I thought I would have another go now.

    We have been with HSBC bank since we got married 23 years ago. Through out this time we have had bank loans, bank credit cards,bank consolidation loans and a mortgage with HSBC.

    Things were easier back then and the bank threw money at us, we deeply regret this with hindsight but we were young and stupid.

    Towards the end we swopped mortgage company cant remember why, probably because we could not afford it.

    All of our bank account, overdraft, loans, and credit cards were consolidated. We did consolidate a few times.
    We were told that we would probably not get the loan if we did not take out the ppi. I know for definite that we had ppi on the credit cards because I found an old statement with it on.

    We did try to claim on the ppi at some point but were told that you could not get ppi on a consolidated loan, so we had no cover that we would have had, had we not consolidated.

    I feel quite angry really and do feel that the bank acted irresponsibly as we now have a unsecured bank loan of £32,000. Which was passed to a collection company and we no longer bank with HSBC. We are now in the process of doing a debt management plan with Stepchange to sort all our debts out.


    I just want to know what are my first steps?
    Do I have to claim each one separately ?
    Does it make any difference the fact that it was all consolidated?
    Do I send off the letters asking for my details about the account 1st or do I just send the PPI questionnaire off.

    I will try to find my old posts as I now have memory problems due to ill health.

    Any help or advice would be welcome

    All you need to do is write a letter of complaint to those institutions which you know had PPI, you don't need terms and conditions in order to proceed. :)

    Do note that the Banks are allowed to offset any monies written off as part of debt management plans and if you defaulted.

    Hi All,

    I have made a claim with tesco roughly 10 weeks ago they replied after 4 weeks stating that they were still investigating and would get back to me within 4 weeks from letter, still no outcome. any ideas on what i should do next.

    also i made a claim through santander for Dorthory Perkins i was a student when i took the ppi out ( working less than 16 hours per week), they have stated i need to prove to them that i was only contacted to less than 16 hours. Then they will investiagte my claim further otherwise it is being rejected. This was more than 10 years ago, were would i be able to get this information to prove that i was only working 10 hours per week, i have tried my employer from back then but they dont hold this information anymore?

    They do normally respond within eight weeks.
    If you've heard nothing give them a call to find out why....

    Looks like you've hit a brick wall with this one.

    Yes I did default and then its been passed to different collection companies since then. I am in a debt management plan and I know they can take it to pay the loan, which I don't mind really although the money would be could at the moment as I have been retired early on ill health, this why we are struggling a bit.
    So how would it work if they have sold this debt to a collection company and then they did the same?

    Include whatever you feel is relevant to your complaint, which you'll have to formulate yourself based on your personal circumstances...
