PPI Reclaiming Discussion Part 5

If you have proof of each monthly PPI payment made, send copies of these in and ask them to look at this again.
I don't think they go far back without you, or, they, having evidence.0 -
Going through paperwork for shredding recently, I found a copy of a letter I sent to Pinnacle Finance regarding PPI & PPP on a car loan in 2005, which did not have a reply attached. I duly sent a copy to them and yesterday received a copy of the response they had apparently previously sent.
According to them, I agreed to take out the PPI over the phone the day after I had taken out the car finance, this was a result of someone calling me. I have no paperwork to support this, in fact I am quite good at hanging up on this type of call, so unless they have a recording of the call to prove I agreed to the PPI, where do I go from here. I also pointed out in my letter that if PPI was necessary, I should have been given the option to choose my own provider. Their response was that they were under no obligation to give me the option.
If they are talking carp, where do I go from here? Or is what they are saying correct re phone call?A smile costs little but creates much0 -

The onus is not on them to prove it was done right. If they say it was done by phone then it will be accepted it was done that way unless evidence exists which proves otherwise.I also pointed out in my letter that if PPI was necessary, I should have been given the option to choose my own provider. We dont know if they phoned you or not. They say they did and if there is no evidence otherwise, then that is how it will be accepted as what happened. There has never been any requirement for them to tell you that you can choose your own provider. They cant insist on you using them but they do not have to tell you that you can use someone else. Much the same as you do not expect the cashier at Tesco to tell you that you can also shop at Morrisons.I am an Independent Financial Adviser (IFA). Truthfully, none of us can know that and bearing in mind that length of time elapsed I suspect the people there don't know it for definite and are merely going on what their records tell them. There is unlikely to exist a recording after such a length of time. The problem with cases like this is it becomes very he said-she said with neither side likely to be able to conclusively prove the matter.
You would be best focusing on any identifiable and valid reasons why the policy would not have been of use to you, i.e. significant exclusions which may have limited your ability to claim or it, or significant (at least 6 months) employer sick pay. However, if you complained about it officially previously and received an official final decision letter then they can timebar any attempt to take the matter further.0 -
I'm waiting for a offer letter from Santander, I called them on Friday and they said they sent it out on 26th but ive still not had it! I received one regarding my mortgage PPI on Thursday that was dated 25th so why is this one taking so long? Should I call to see where it is or wait a little longer?0

I think you might mean Cardiff Pinnacle the insurer rather than Pinnacle Finance. I can't tell you whether they phoned you but can confirm this was one of their business models. They had agreements with car dealers whereby lists of customers who had taken finance but had not purchased PPI were passed to them for re-solicitation.0 -
I have got my PPI offer from HSBC I couldn't remember the exact figures but looking at the details they have sent me I was paying an eye watering £70 a month in PPI payments!! Anyway there is a passage in the letter that states
"As a result of my decision, it is not my intention to respond specifically to the individual issues that have been raised other than to explain how I intend resolving the matter"
How do they uphold my complaint but not tell me why? I mean I know my reasons were valid but I would have liked details on how they came to their decision. I have had other PPI back and this is the first one that says anything like this all the others say something along the lines of we have been unable to prove you were eligible for the policy blah blah0 -

it could be something you complained about. It could be something you didnt but they found or it could be an auto payout and you are getting lucky.
However, it is quite normal for firms not to explain the points as people tend to still go on arguing rejected issues even if their overall complaint has been upheld. More to the point it is simply a waste of time. 99% of people don't look at anything in an offer letter other than the fact they are getting an offer and the figures.0 -

I do like to read things thoroughly which is why I would rather they state why they upheld my complaint, I wouldn't like to think I was getting money back that I didn't deserve. It makes me feel a little odd that it would be an auto payout. However the loan was taken with HFC who were not the nicest to deal with, they would harass me on a monthly basis trying to get me in cause they could provide me with "a better rate". The branch was one of those you had to ring the bell to get in and on at least one occasion I felt like I was being held hostage till I signed.0
