    You can't get agreement details on closed accounts.
    The Bank say they no longer have any details of this old finance but, if you don't believe them, you could write them a Subject Access Request (SAR) letter which will cost you £10.
    If the SAR also returns nothing and you have no documentation from your own archive then any mis-selling complaint is over before it's begun.

    I have registered today as I have a couple of questions. I have been a long term reader over the years and have got plenty of advice. However it's come to the point I need to ask something.

    Anyway, I have just started a PPI complaint with Natwest bank. I do not have any paperwork. I took the loan out in November 2004 for £5000 a few years later I increased it to approx £15,000. This was to pay back what was left on the original loan. I then consolidated my loan payments with my overdraft which took it to approx £17,500. I then consolidated my loan again to lower the monthly payments. All with Natwest.
    I have been made an offer which personally I think I'm happy with bit I just want to make sure I have not been done over.

    The offer £1,185.92

    Am I entitled to call them and ask them HOW they came to that amount or should I just accept it?

    Should I get the financial ombudsman involved or would that make it worse?

    Just thought I'd give a little update.

    Spoke to natwest who have basically said that because my loan was consolidated the PPI was only on the first loan but stopped on all subsequent loans hence the low price. I'm happy with that as it makes sense.

    Should I just accept the offer or should I fight it further. I have no proof that what he said to me on the phone is incorrect.

  • So - BoS/Halifax rejected my claim.
    Firstly they said i never had PPI and send a copy of my original form with me ticking the no to PPI box. Then when i told them i took it out over the phone when activating my card they rejected my claim saying i met all the right criteria.
    Took it to the ombudsman - who found in my favour - and i've just got a letter today from HBOS saying they are happy to tell me that according to their records they can confirm i never made any payments into the policy so i am not out of pocket so they wont be paying me anything back.
    I know this isn't the case - i remember my old statements with PPI itemised on the bill!!
    But of course - i don't have the records.
    Anyone else come across this???????

    You remember the bills even though you didn't keep them? :eek:

    I don't think the bank (or anyone else) will be convinced…

    Yes. But I am hot on paperwork and keep everything. I have every bank statement, credit card statement, mortgage paperwork from 1992 to date.

    Should get interesting because if they dispute my claim I have all the original paperwork to back up my case :)

    Neither are banks, especially with the PPI mis-selling debacle.

    Saying you "remember" 20 year-old bills will never be accepted as evidence, I'm afraid, and it would seem your complaint is now over because there is no one else to refer it to.

    If you refuse to believe the Bank's version, you can send them a Subject Access Request (SAR) letter to see what remains on file for you.It will cost you £10. If this returns nothing and (as you say) there is nothing in your own archive to support your assertion then you'll just have to forget this.

    You should have already sent copies of random samplings of this evidence with your complaint. Failing to do this in the first instance will likely delay any payout, if the Bank have destroyed their records.

    Do remember that proof of payment is not proof of mis-selling…

    did the SAR thing - they cashed the cheque and sent me the copy of my original application where i did not choose PPI. that's all they sent as my record. Later in the year they agreed my PPI policy started on a specific date on 2001 so i don't particularly believe anything they tell me initially.

    if they're saying similar to other people i'll ask them again.

    Seems like a waste of a further £10.
    Have you approached FOS over the seeming discrepancy between what they sent you and what they eventually admitted?
