I just want share my story of my claim with MBNA (had c/card since 2006), my FIRST claim......
Jan, 2012 - started looking into 'DIY' PPI claims
Jan 27, 2012 - sent letter requesting copy of my credit agreement (used letter template on MSE)
Feb 13, 2012 - received Agreement and T&C's ( I HAD ticked the box!!)
Feb 20, 2012 - sent FOS' PPI questionnaire (downloaded from MSE)
Mar 1, 2012 - received letter saying they're investing my claim
Mar 14, 2012 - received letter saying my claim is being UPHELD...interest an' all!
£2,273.42!! WHOO HOOOOOOOOOOOOOOOOOOO!
Best of all - I don't have to pay any of it to a PPI Claims Company!!! If I can do it...and I'm blonde, y'all can!!!
....MEGA thanks MSE and all who give the valuable advice on here!! :T0 -
:o you are too kind :A
Ring them up and ask them to add this front loaded to the complaint, tell them someone mentioned this to you
They should find all the loans from the loan number of the first, the reference numbers should be fine.not at all you are a star :A
I will phone them tomorrow and ask them to add frontloaded to the complaint.
Thank you again Amersall  I will let you know the final outcome0 -

Hi!!
Yeah mine was an online appilcation (I remember I got to choose what 'style' of card I'd prefer!) The box was 'hand written' ticked - not sure if I ticked it or it was ticked for me...hard to prove but under it, it stated that I was agreeing to the T&C's set out as in ''paragraph 1.16'' of the agreement!!! I searched high and low through the T&C's AND the credit agreement and there was NO parargraph ''1.16''!! Mine was from 2006 so not sure if that applies to you.
Also look in your T&C's/credit agreement - in paragraph 12b of the credit agreement it states "If you ask us to arrange insurance on your behalf we will treat this as your auhority to ADVISE ON and manage any insurance policy for you" So even if you did tick the box it is the business' responsibility to ADVISE ON their insurance policies, to uphold their own T&C's - if they did not do this the business has not done it's job properly as set out in it's own credit agreement and therefore the policy is not fit for purpose!!
Hope that helps!!!! Good luck!!!0 -
