    You don't get a refund because you ask for one, and the FOS will only uphold if your complaint is successful.
    There is no 'fairest way'. If there is proof or reasonable doubt that you were missiold, they will refund you, if there is none, they won't. If there is no paperwork, it is even less likely there will be redress because there is no longer proof.

    LLoyds TSB finally pay out, after refusing to uphold 3 loans back in 2012.

    No FOS, just annoying old me :)

    started process JAN2012.
    Lloyds TSB refused my claim April 2012.
    I appealed the claim May2012.
    Called at least every 3 weeks from July 2012 to September 2013 to PPi call centre. it was like banging a head against the wall and being told the same scripted, robotic answers again and again. Told my case was in a que and with the right department but they are experiencing a high volume of complaints, blah blah.

    I kept checking back here and noticed some advice to email the CEO Mr Horta-Os!rio. I did that and got a response immediately by the CEO exec team and received payment into my account 2 weeks later.

    Im very happy that i don't have to make the same annoying, time consuming calls anymore. case closed. Never give up people!

    Just make sure you have the evidence to prove you where mis-sold.
    Luckily I still had my old third party policy and membership numbers.

    Yes, just that one sheet of paper showing we did have PPI.

    don't forget the £10 cheque for each otherwise they will ignore your letter.

    It was the template letter for closed accounts in step 1 of the MSE guide.

    Just getting first responses back

    EGG/Barclaycard have replied with a print off of account number and a 'N' shown against PPI. They returned the cheque.

    Co-operative replied saying they were unable to trace the information without account numbers. They also returned the cheque.

    I have noticed one cheque has been cashed so maybe thats a sign I did have PPI with someone.
  • Nat West persuaded me to convert a £25,000 overdraft into a loan with monthly repayments and an application form was given to me to sign with the PPI declined at my request. It transpires that a policy was set up on the account without my consent or knowledge and RBS (NatWest) have written to me inviting a claim, the outcome of this is still pending. Had I known PPI existed during a 9 month period of redundancy and unemployment I would have claimed. I feel a deception took place and wonder if any other members of the forum have similar experiences and should I also take legal advise on this or just let the claim run its course.

    I've read a lot about reclaiming PPI. I know I cancelled a card that was charging me for this. I've done credit checks on Experion and looked through all the paperwork I have but I still can't see who it was.
    I rarely use credit cards so only have had a couple I am pretty sure it was a type from Halifax can anyone give me any ideas how to find it as its certainly over 5 years ago.

    FOS don't do awarding people 50% refunds. To use the gambling vernacular it is all or bust. They will basically award you a refund if they think it was more likely than not that you were Mis-sold the product and wouldn't have taken it otherwise. If not they won't.

    The problems with trying to show this in a mortgage PPI case are as follows:

    1) MPPI is almost always a separate stand alone direct debit from your bank account to a separate insurer which you would have had to sign a separate direct debit form for. You've stated yourself it was on your paperwork. I'd say its very likely you cancelled it at some point because if you didn't you'd likely still be paying it.

    2) Bearing in mind the size and importance of mortgage payments most people who take one out do have a clear need for MPPI. Hence you would need to persuade them that you didn't.

    3) And most pertinently, the number of people who swear blind they never knew they had PPI when they've just forgotten is ridiculous. It's not just PPI either, people come out with the same spiel about all sorts of other mortgage related products which they mistakenly lump under the same banner. I have known a case where a complainant swore blind that she had a PPI policy which she never knew about and when she sent the "evidence" in it turned out to be a with profits endowment, the investment vehicle which was designed to pay off her interest only mortgage!!!

    For all of those reasons I think you'll struggle with this one I'm afraid...

    They won't do it just because there is an element of doubt. They have to be convinced that it is more likely than not that the policy was missold and the complainant would not have bought it otherwise.

    The process they use to come to this conclusion is an entirely different debate...

    You can 'feel' a decpetion took place but unless you can prove it, you're going nowhere with it. PPI is not a legal issue so there's no pointtgaking any legal advice.
