    I'm new to forums so please bear with as the question may have been asked, I did look but couldn't find it, so here goes

    I used a claims handling company for my PPI claim on a loan from Black Horse which was initially rejected but then forwarded to the Ombudsman who had more success and got me my money back. Question is do I have to pay a percentage of the successful claim to the claims handler, as in my opinion it was the Ombudsman and not they who were successful with my claim or am I legally obliged to pay them commission?:p

    You are legally oblliged to pay them. You signed a contract.

    Your contract probably also says they can represent you in all PPI claims so if you don't want them to do this, i suggest you cancel your contract, for which you will also have to pay a fee.

    After reading about this PPI business I decided to look into my own borrowing history. In 2010 I took out a credit card with Halifax to take travelling with me. I filled out the credit card application online. I've just been rummaging in old files to see if PPI had concerned me at all and found my policy for repayment cover insurance for my Halifax credit card. So firstly is this PPI?? I wasnt contacted about this policy at all and actually before finding this paperwork I had no idea I had "repayment cover insurance". It does say in the covering letter that its optional, but as this policy wasn't explained to me beforehand I had no idea what it meant. Was I just meant to know? What I also find confusing that in the policy it states that in order to be eligible for cover I needed to be in paid work, which I wasn't - I had just finished a temporary contract before I went off travelling. I'm nervous of calling up Halifax to discuss this as I'm not sure what on earth to say?! So I thought I'd just post to see if anyone can shed any light on this for me? Thank you for any guidance or clarification.

    Just a bit of information I need hopefully you can provide.

    I had a credit card with Capital One so I did the usual and sent of the form to reclaim the PPI, they wrote back and said that I had rang and requested that 12 months after I took out the card????
    I know I didn't so I took it to the FOS and 3 months later they wrote to me and said that they didn't think I had been mis sold the Insurance at all so there was no claim and reeled off a load of things about that because I was in employment and could meet the payments even if I went off sick. I thought this wouldn't count surely it is the way the Insurance had been sol, is it me being thick or are they right and would I still be able to do something or not.
    I am waiting a decision with them at the minute on the Bank of Scotland who said that i had ticked the box for PPI but when they sent me a photocopy of the agreement I hadn't ticked the box at all, so I am now waiting to see what the FOS decide on this case too.

    Had always been meaning to reclaim for months but just never had the time to sit with OH properly and sort it out. We had a phone call from one of the companys that can help claim it back. OH gave them our details and they typed it all up and sent it to OH to sign. We stopped short at this in the end and set aside an evening to do it. We printed off the forms on here but as there had been a couple of loans in the distant past we weren't sure whether to send all the info at once. We had paperwork for two, which had been joined together, iyswim, but no info for the other 2. I went on the Natwest home page and it gave a telephone helpline number to ring. Last Monday OH rang them up. Gave them the details we had and the guy who he spoke to looked there and then. Was very helpful and could find some info on the more recent but not from the others. We had a letter a couple of days later acknowledging the phone call and this morning a letter arrived with an offer just short of £5000. It was the amount OH had roughly worked out it should be but what a surprise!!!!!
    We obviously need to do a bit more regarding the other 2 loans, Natwest said that on one we didn't have PPI and he couldn't find the details for the other but just at this moment we're so pleased with everything going so smoothly!
    We really are those kind of people who think 'what's the point, we never have any luck with anything etc etc' but this shows you never know unless you try. In the end we didn't need to send any papers off to the bank. It all took a 5 minute phone call and virtually a week from start to finish!
    Don't put it off, just do it.
    Sorry for the epic post but hope it nudges people in the right direction.

    Capital one have a low uphold rate because most people purchased via post or online, where you choose to have PPI, so it can't have been missold, it was miss-bought
    Once FOS has made a decision you can ask an actual ombudsman to look at it rather than an adjudicator, but you're only prolonging the inevitable.
    It is possible you were sold the PPI over the phone at a laterdate but if it was prior to 2005 there won't be a telephone recording to show how they sold it, but only a sales pitch which the FOS have accepted as having happened.
    You'll have to wait and see what RBS come back with.

    Make your complaint. PPI is only charged on the outstanding balance though so if you regulalryl paid it in full, or had a low balance you won't have paid much or any.

  • I have been waiting for my PPI cash of £500 from Barclaycard for 7 weeks now. The 28 day payment time frame ran out on 18th Jan. I have chased BC twice now, and both times I have been advised that it has been esculated and that I will get it "soon."

    Can I take the matter further (FOS) or do I just have to sit it out and wait?
