Thanks for the advice. I think i will call WF and ask them to reset the loan without PPI so that i know how much i owe and how much i should pay and also how much i have paid so far so that my PPI claim can offset the balance thereby reducing my monthly payments. Point taken, shall continue to pay but at a reduced amount as i understand they cant refuse whatever payment i offer.

You are welcome, pardon the pun :)

All you need from Welcome is the statements of your account to date, contact FSCS and ask if you can put the claim into Welcome as you need to win mis sell and get the whole PPI taken off the balance, Welcome will not reset the loan until you win mis sell, let me know what FSCS say to you putting the claim into Welcome.

I have a mortgage through allience & leicester (now santander) & at the time to get a better rate I chose to open a premier current account - the credit card was given to me as part of the current account. The credit card is MBNA but was given via A&L so my question is who do I send PPI claim to?? please help!!:(
If you get statements from MBNA then they are the ones you put the claim into, if they took over from Santander it is possible they will only pay redress (if you win ) from the date they took your card over, Santander should redress the time from when they had it to the date MBNA pay you out, it is possible that MBNA will pass the remaining claim over to Santander.
  • Tried to get my loan info for my ppi from abbey national but because over 6 years ago I was told to send a £1 checque to archieve Santander Bradford po box 1111 Bradford bb1 9nq for them to send me a letter back four weeks later stating there's nothing they can do cos It's over six years old they destroy everything due to the data protection ,surely this can't be right ??? ( they did send the cheque back) iv contacted Santander again and they weren't much help either stating I can't take it any further !!! Help

did the FOS ask whether or not you had finacial difficulties?
I have now been waiting about 10 months since first complaining to MBNA and 7 months since then forwarding to the FOS

Yes they did, but you must keep up the contact. Its hard work but I would suggest writing to them both once a week, it has taken me 5 months to gain a reply from NatWest. I feel its all a game to them and I think they hope you will give up but trust me don't.

I have my account number etc., but can't find the credit agreement
You only need the account number and reasons for mis sell to put a claim in.
As they only pay out for the last 6 years of PPI and you cancelled the PPI a year into the card, they will pay you (if you win) that 12 months of PPI so you do not need to do a Sar, if you win, they will take this off the balance of the card.

Not bothered about upsetting MBNA but will this get there backs up? and will then even look at it if they have rejected it twice themselves and once through the FOS (awaiting and adjudicator now)

If the FOS has rejected it then I personally would give up but if anyone else looking at these posts has any other ideas please feel free to give some advise.

I don't think the FOS has rejected it, they say that they have contacted MBNA and they rejected it, and the FOS letter was to say it is now awaiting and adjudicator to look at it in more depth I think. they have since sent another letter to say they still haven't had chance to look at it.
I suppose I was hoping someone would say they are getting through them quicker now!
