    Can you pliz enlighten me, i used a third part to claim for ppi with a bank, this claaim was rejected. The third part wrote to me and said they were closing the file as this was the final response from the bank. I took it upon myself whem they couldnt helpme, i spoke to the banks customer services they promised to look on the case again, which they did, i never communicated this to the third part. However when they wrote to me roughly about three months later( third part) to say they were opening a new claim for my other loan to the same bank not the one they had closed the file. I asked them to stop because i knew the bank was already processing the two claims. However when the offer from the bank came. A letter by the bank was also sent to the third part, which they quickly wrote to me saying they had secured an offer from the bank. I wrote to them explaining that according to the correspondence i have with them, they had closed the case, therefore i was not willing to pay them as i never went back to them regarding this issue to ask them to open up the file, because they had said they would only open it if i furnished them with more information. I never went back to them, i never informed them that i had actually contacted the bank and the bank was only communicating with me up until the offer letter which the bank also sent them a copy and they became aware that this clam was now in progress. Now they are harrassing me they say i have to pay them. Plaese advice me.

    If you have the letter saying they closed the file and you did not sign another contract for them to do anymore work for you then you need to contact them and tell them this, if they do not stop contacting you for payment for something you did not sign up for them to do then you will report them to the MOJ.
    Ask them for the contract you signed that shows you gave permission for them to chase other claims.
    Then report them to these.

    What should be my first step. I have no paperwork, except my last months statements.

    Many thanks. I ahve had to use this card on many occasions, regularly having thousands outstanding. It is however up to date with minimum payments.

    All you need is the card number and reasons for mis sell to make a claim

    Also friend had a couple of loans and on bank statement it said AA financial, so am i to contact the AA or find out who they do their loans from?

    The email is right and it is AA you need to contact in the first instance.

    I have submitted a PPI claim for compensation on a personal loan taken out with Alliance & Leicester (now owned by Santander) for £13,000.

    My reasons for submitting the claim for compensation were as follows:

    1. I genuinely did not realise I had been sold PPI (the loan was arranged over the phone)
    2. I was self employed at the time of taking out the loan.
    3. I had a pre-existing health condition (Juvenile Rheumatoid Arthritis since the age of 5)

    I only discovered the PPI element on this loan when going through old paperwork in response to all the media coverage on PPI claim back. I had a statement from 2008 detailing the original loan amount, and a figure of approx. £754.00 for an Insurance premium and a further figure of approx £210.00 for Interest on the Insurance premium, these figures were added to the account at the start of the loan.

    Now I should point out that this loan was taken out way back in October 1998, but the account was only finally settled in 2010.

    During 2000 I had to stop work due to severe problems with Rheumatoid Arthritis which subsequently resulted in me requiring two hip replacement operations. This situation meant that I was unable to work for approx 2 years during which time this loan fell into arrears.

    Had I known I had PPI I would obviously have tried to make a claim on the policy, hence my assertion on point 1 above.

    I downloaded and completed the Moneysupermarket PPI claim form as appropriate and sent this (recorded delivery) along with the statement mentioned above to Santander on 03.02.2012

    They replied a week later with an unsigned standard format letter stating they could not investigate my complaint as they could not trace the account. It went on to say that as insufficient information been provided the complaint would not even be registered with them.

    Having sent them a copy of my loan statement which clearly shows the loan account number and the amounts taken in respect of PPI I found this unacceptable. I again sent them another PPI claim questionnaire and statement which clearly shows the loan account number (recorded delivery) this time with a strong covering letter on 15.02.2012, three weeks later I got the exact same unsigned standard format letter mentioned above.

    I guess they are doing this so that they can avoid the 8 weeks response time imposed by the FOS, but I feel as though I am banging my head against a brick wall and wonder if I should approach a Claims Management Company.

    Any advice anyone can give would be much appreciated.

    i was sold a life plan on two of my mortgages by hsbc a number of years ago, i was clearly told i had to take it and also they led me to belief it had to be taken with them as the mortgage lender,it says on my a/c on the internet,,,life plan/mortgage protection plan,,i just want to know is it worth me taking this further or would it be a waste of time,thanks guys.

    The loan will have the total ppi payment taken off and your monthly payment will reduce by the ppi amount.
    They are resetting the loan and giving you back what you have paid in ppi to date.
    The extra interest they are putting back into the loan is for the ppi interest that, had you not had the ppi then the loan would not have reduced by this amount, that is why you do not get this back.

    The 8% is taxable so you should inform HMRC to pay this if the bank do not take it off before they give this to you.
    What was the original loan term and ppi monthly payment?

    loan term was 240months.
    i worked it out the ppi payment is around £66.34 (£138.71) p/m
    The loan payment is around £187.50 (£392.06) p/m
    Total being £253.84 (£530.77)
    (Interest @ 9.1%Apr)

    So would you think this is a fair settlement?
  • firstly i would like to say that i work as a customer services rep for a credit card provider that speaks to customers daily about their ppi mis-sale claims.
    I have recently called cap one to ask what their "procedure is for reclaiming mis-sold ppi" they advised me i did not have it on my account....this is incorrect as i had remembered cancelling it about 18 months ago. after asking several questions and making her check her details again, she confirmed i did have it when i took the card out and the date i cancelled it. after telling her what i thought about how she went about "finding" this info out, i asked for the address to send the template letter from here to cap one.

    i have just got off the phone today with debenhams "santandar" with the same disgusting fob off of "you have not got it on the account" i know i did because i have the customer agreement copy of my application form in front of me!! after getting the telephone number of the insurance broker i have logged a very quick and simple missale complaint with the company. after then calling debenhams back to speak to a manager... he advised me they do not have systems in place to check earlier than feb 2010 (took the card out feb 06) i told him their customer service procedure for ppi missale is not acceptable and there are clearly training or educational issues with their staff!! he offered me a £10 credit on my account as i had called back a second time (pays for the phone calls it took to get sorted!!)

    please read this and just think to yourself "have i really got the true honest answer from these companies" if not ask for a manager or provide proof of no ppi on the account! dont be fobbed off by them and especially if you think the "communication" is diffficult to understand....script comes to mind :) good luck:)
