:mad: Ring them back, tell them you have the proof they were signed for and you will be putting the complaint into FOS if they do not "find your complaints" :D tell them FOS will go by proof of delivery so tell them to get their fingers out their A**E :p or you will hire a JCB and tear their office down :rotfl::rotfl:
Seriously though i think they are stalling, even sent to the wrong address they are the same company and these should have been passed on .
Good for you for not giving in :D

Hi amersall. Thanks for your reply. The mad faces on your post was just how I felt yesterday after coming off the phone.
I have just phoned Post Office with my track and trace number and hey presto it was delivered on the 2nd March. So it must be in that building somewhere. I had tracked it online but just wanted to be doubley sure.

Armed with this information I will ring Lloyds tomorrow....

Hi Devenney if your family feel they have been misold it's very easy to put a complaint in, Don't use a claims company however tempted you are and whatever they tell you, put in a fos questonairre in printed form from the reclaiming link

Thanks Cappo for the reply, I am pretty confident with the reclaim process but what my question is really about is can I reclaim on behalf of a friend or family member who is unable to claim due to poor health or just simply doesnt have the time or whatever the reason may be?

    Any help would be appreciated.

Hi All new on here looks a great site
OK I took out a loan with igroup in June 2003, the PPI was a joint with wife @ £7,200 over 5 years. We cash settled the loan in January 2004. 7 months later.
The broker was loans.co.uk, there was no refund of PPI and yet there was no insurable interest on the Lender / Insurance Co. To me this seems a blatant case of daylight robbery:) But my worry is any claim may be rejected for being time barred, (2003) and the lender was not Under CCA regulations.
The lender at the time insisted that if we didn't take out the PPI the loan would be 'in doubt'.
I have only recently dug out all the docs, what does the forum think do you think we can win?

Hi it is a great site lol, it's a bit tricky you could go after the insurer if the broker was not covered at the time of the sale, as to the year it's 6 years from the time you could reasonably expect to have known that you were possibly misold which was last april with the BBA.s judicial review of the fsa's new retrospective rules so you should be well within time.

Hi again devenney you can claim for whoever you want, although your family member might have to write to the lender giving you permission to conduct the claim for them, you would probably also have to give reasons for doing it for them. Good luck.

If they have no proof of PPI paid, they will not pay any redress for the dates of these cards, do you have no statements from that time at all?.
Put a copy of the letter in from MBNA and let them have a look at this, see what they come back with.

HI have sent letter off today ...I do have two statements which I found one from 2004 and one from 2006 showing payment protection coming off my bill. I used to have all my statements but somehow in moving these have got lost or thrown out by someone

mbna were able to tell me it was taken out in 2001 but they seem to have only taken responsibility from 2007?? just hoping paperwork they held showing this information will be sent along with any documents to santander as they were ones that sold or missold this policy to me

    will post reply

    thanks
  • The problem when people ring the customer service departments such as Lloyds etc, they just seem to get fobbed off constantly and they dont seem to 'have any record' of letters or 'who you spoke to last'!!:(
If you get the right addresses from where you need to contact (which there is loads of help on here from lots of helpful people!), and send everything recorded delivery, you should get it to the right destination eventually!;)Also because there are so many PPI complaints going through over the past few years, they're just being bombarded with people from everywhere, and you would think by now they would know what they are doing or should be doing - HELPING PEOPLE sort their complaints out!!
Amersall and Di3004 are very helpful on here :AGood luck!

  • Hi all!
Please can you tell me if i can reclaim PPI from a company that has ceased trading? A CMC called recently and told me that there is "a pot of money" set aside for such a scenario and that they could reclaim my PPI from this.
Another question i have is Re BMW finance - would i have been sold PPI with this?
    Thanks guys
  • I had a mild stroke in 2009, which resulted in me losing my job. I phoned Littlewoods catalogue to ask them to cut me some slack for a while and they told me to stop paying them, go to the CAB and see what they advised. I did all that and the CAB advised me to offer a payment of £1.00 until I got back on my feet. I rang Littlewoods again and they told me to claim on my 'easy cover care' insurance, which I didn't even know I was paying. Litts gave me the tel number of the insurance company covering them (and me). I rang them to find out what to do and they told me that I had NO claim as I hadn't kept up the insurance by not paying Littlewoods for a month.:( I have not been able to gain full time employment since 2009 so have little money to pay any of my debtors.

I have been stewing for years now as Litts are the only ones who have not accepted a payment plan ( I pay them £5.00 per month anyway, whether they like it or not, as per CAB advice) but have found out recently that they are still piling on the interest (I owed them £600.00 in 2009 and I still owe them over £1000.00 now).

I was wondering if I could claim my 'easy care cover' back which would help me pay Litts a lump sum? I do not have any paperwork left (as it was three years ago I had my mis-fortune) but I was with Litts for about 30 years and have always paid 'easy care cover' as I thought it was a condition of the terms. Please could someone advise me if I am able to claim anything that could help me

Ok could do with a little help with this one , it is a complaint my wife has made , the application was made online with the halifax in 2002 and my wife is adamant she wouldnt have taken out the ppi as she recieved full sickness pay and a good redundancy package. They have rejected the complaint with the following.

" i am aware that the documentation that you were provided with both at the point of sale and after purchasing your ppi policy, such as the summary of the policy and policy booklet fully explained the benefits and limitations of this policy.

In particular, i have reviewed the information that we gave you about the exclusions and limitations of the policy and i have concluded that these were explained to you sufficiently , clearly and you were not significantly affected by them. ( just to add my wife has asthma would this be considered a existing medical condition?)

I can confirm that it has never been a requirement to take out a ppi policy and have concluded that the documentation you were provided with was not misleading in any way. I have therefore come to the conclusion that you were made aware of the optional nature of your ppi policy.

I can verify that there were no alternative policies available at the time of sale. When considering the information available during your application and your policy booklet i can conclude that we did supply you with sufficient information to ensuer you could make an informed decision as to whether the policy met your personal requirements, it cannot therefore be concluded that the information and disclosure given was inappropriate in the circumstances. "

The letter goes on to say the usual "my review has nit highlighted any failings with the sale that would lead me to believe your decision to purchase the ppi policy would have changed". My wife is certain this must have been an 'opt out ' box or the box was pre ticked , she has asthma , got full sick pay , i could have easily payed the bill if for some strange reason she could not.

A few pointers would be appreciated as im not always the best at forming a structured letter, my wife is going to write back and if the complaint is still rejected take it to the FOS.

Sorry for the long post :)
