Hi all
I've recently sent off the form to MBNA in the hope of reclaiming my husbands PPI - they've sent us a copy of the original agreement and he has very clearly ticked the NO box next to the PPI question, yet its on every bill we have so fingers crossed we have a strong case!
Next is his old Burtons card. It was closed in 2009, and as far as I know as administrated by GE Capital Bank (later GE Money) throughout the period. I understand that Santander now run the Burtons card. We've written for the T&Cs to GE Money (with a £1 cheque), but no reply (its been a few weeks). Are we chasing the correct people, or do we now need to go through Santander?
Either way, does anyone know the correct address to contact, or where I will find it?

Around Oct/Nov last year I wrote off to Capital One stating that i believed that they missold me PPI (I dont know if they did or not as I no longer have the ppwk but thought I would chance my arm anyway). They then wrote back to me to say they checked it out and confirm that there was no PPI on my account.
I was not convinced as I was paying them quite a lot each month and my balance was never getting reduced so from advice on here, i wrote off to them again with a cheque for £10 asking them to provide me with all of the information they held on myself and my account. I believe they have 8 weeks to reply to this but as yet, I havent heard a thing although they have cashed my cheque so definately received my letter.
Just wondering what the next step is as they havent responded to my request within the time period, can I write to them again or go straight to the ombudsman??
Any help would be much appreciated,

Not sure what MBNA are up to but about 10 days after I sent everything off to the FOS, I got another letter from MBNA saying they apologise for the delay in looking into my case, but that they will have a response by the 4th April.
They had already said their last response was their final response!!
Any how, yesterday I got a letter saying that they are upholding my complaint and say they will be sending me a cheque for £10,409.61 in the next 28 days.
Next stop First Direct who messed me up totally a couple of years back by closing my cheque account just days before getting paid and direct debits were due. Simply for having missed 2 payments on my credit card balance which was about £2550. I had PPI with them for loans and credit card, so hopefully claim enough back from them to cover what they are due. Top bank when you keep in credit maybe and when i had money they used to phone offering all sorts. As soon as they see you are struggling - off with your head!!!

With the Burtons card you will have to do a Sar as the account is closed, this will cost £10.
They will not give a copy of the agreement for a closed account.
Ask for all info they hold on you and not just an agreement, give them 40 days to respond.

It is GE if the account was closed before the others took over, but i do not know the address, maybe someone will know and post up for you, maybe give them a ring and ask for the address?, it could be the one you have already sent this to.0 -

After reading through the threads it's now given me the courage to go ahead with my claim. Hopefully someone can help me with this, we have a secured loan from Blackhorse :mad: (biggest mistake of my life) £15,000 in 2008, I can't remember the context of the meeting we had with them but I know I told them if we were off sick from work we get 6 months full pay and 6 months half. At the time we were desperate so I would probably have agreed to anything, but when I looked at the paperwork and noticed that the loan is £319 per month + £123 ppi!!! I know 100% I would not have agreed to paying that amount for insurance (I'm starting to go on a rant) anyway my question is do I call them (as they have a PPI enquiry number) or fill in the form, do I cancel the PPI and claim what I've paid previously or do I claim first then cancel. We are in arrears with this because they do say you can have a "holiday" but I was unaware this put us in arrears and with the amount of interest they put on this as it runs as 2 separate payments it will soon be up to the same amount as the loan, I pay extra every month to try and clear it but they will not be happy until they get all my wages :mad::mad: I don't mind if they use what we are owed to clear the arrears (although I would like to get something back). On another matter has anyone had any dealings with London Scottish I think they are now in administration but I have had a few loans with them in the past?? Sorry to go on a bit but I don't know what to do and Blackhorse get my blood boiling.0 -

I think I'm being thick however (not a shock) - do we need this in order to get application dates etc and if so, does anyone know if we are likely to get this information back. The info on the link says they sometimes only give information 6 years old, but the card was taken out in the 1990s. Is it worth filling in what we know on the questionnaire without getting the SAR info, or is that really essential to have a good case?

Give them a ring and ask, if they have a backlog then this could take time, it is possible it is in the post as we speak!.0 -

If you have the card number and reasons for mis sell, just put the claim in, you do not need anymore info, any questions on the form that you cannot remember then put that you do not remember.
Some find info from further back than 6 years, this depends on the company0 -

The reason for mis sell of this PPI is that it was front loaded, this PPI was in fact a loan on the loan that you paid to term with interest, get the complaint in, put you have just become aware of this Front loaded PPI and that when you took the loan you do not believe you were given enough info on the true cost of this PPI to make an informed decision.
If you win redress the arrears will be taken from this and any left will be given to you, but the joy is the PPI will gone 100% from this loan and that will save you all the interest that you would have paid back, and your payment will go down too!!.
You can log this over the phone or send the questionnaire off, if you do it over the phone then i think they send you the questionnaire anyway!!, keep a copy in case you have to send this to FOS, it should not come to that though.0 -

Firstly could I just say thanks to amersall for your encouraging words.
Here goes: phoned Lloyds TSB and spoke to Daniel. He asked for my post code and said there was nothing on the system. I explained I had a receipt for postage and I knew it had been delivered. He then asked how do you spell your name. No he still couldn't find anything on the system. He then asked me for my loan number;) I said which one, I have 4 complaints here. His tone changed and he became very helpful.
I gave him the loan number and he said it didn't sound like a TSB loan, I told him it was Blackhorse.
He then gave me the phone number for Blackhorse, which he told me is in the same building. He also said that if my letter and forms had been received they would have been passed to the Blackhorse department.
I then rang the number for Blackhorse and spoke to Richard who tried to tell me I needed to ring the number I had just spoken to Daniel on. I told him this was the number Iwas given to ring about my Blackhorse PPI complaint. He tried again to tell me there was a dedicated number to ring. I said I have 4 complaints that need to be dealt with. He asked me to hold the line and put me through to Ashley. We went through all the security questions and he said he could not find any complaint. He then asked where I had sent the letter and forms and said I had sent them to the wrong address. He has given me the address in Cardiff. I now need to send copies to this address. Ashley then told me they have 12 weeks initial time to deal with the complaint(he did mention they are moving a bit quicker now) and if they find in favour then its 4 weeks after the waiver has been signed.
So sorry for such a long post, but I thought it was important to get it all across:D0
