I took out a £7000 loan in 2000 with beneficial/hfc,i'm sure ppi was involved on it even though i have no paperwork now.

Due to relationship breakup went off the rails for a short time and stopped paying the loan, and within one month, and 14 days of missing first payment i was taken to court by benefical/hfc without me knowing about it(said i'd been informed by letter, but never received one). no surprise that i lost case, debt was now around £12,000. (loan plus court costs)

debt passed onto restons solicitors...had a payment plan set up with them since court case of a set amount every month, and i'm still paying it today(most of debt paid off though).
As i'm still paying off the debt would it be possible to claim ppi off it even though its a loan from 2000,and i only paid less than 12 months instalments on it,before loan account was closed, and it went to court??

You certainly can, any redress that you get may be taken off the debt, but the whole PPI will be taken off the balance and this may even clear the remaining balance.
If you paid one monthly payment to this loan that included the monthly PPI amount, then this was front loaded ppi, this means that the PPI was a loan on top of the loan paid to term end with interest, use this as a reason for being mis sold, this is the most upheld of PPI mis sell.

Well my subject access request has good into tesco to get my ppi details as they changed computer systems last year and can't get it otherwise. The loan was settled post Sept 06, so just hoping that it will show the ppi on it and amount as the loan itself would have been taken out in 2002. Do you think something should show this...I have a current loan with one payment left as by taking this out I realised ppi did not give me anything more than work gave me.

ALso going to santander for my store cards, should I send one questionnaire for each card? Again ppi was cancelled years back now once came to understand it all....but taken out in 98 ....so not holding hope because of pre 2005.
With Santander, you could put all card numbers on if the reasons for mis sell are the same and ask them to look at all of these.

Some MPPI is not reclaimable especially if this was a stand alone insurance and not included in the mortgage monthly payment, post the question here
    http://forums.moneysavingexpert.com/forumdisplay.php?f=187
They have more knowledge regarding MPPI, if you do not have a claim for mis sell then this will save you time asking for the agreement.
Thanks Amersall, I'll check that out

    Hi and welcome

When you say you made a claim, do you mean you made a claim for example, sickness/unemployment etc?
If so, the amount would be reduced by minusing the amount received for a claim made.
Otherwise if not, did they forward you a breakdown on how they calculated the refund?
Ask for one if they didn't, they should send a detailed one on request.

Maybe when you receive them, you can post them on here and one of the folks can work out what you should be receiving back.

Wonder if they gone all the way back to 11 years, from when you first taken out the account?
If not, maybe you could send them any paperwork you have in relation of the account and ask them to consider going all the way back from when you first started paying for it.
    It soon adds up.

Hope this helps but maybe someone else will be along soon with some better advice on your best avenue here, good luck and well done on your success!;)

    Hi there

    Well done on your success.

I would write to the bank to find out what is going on, you are correct, that normally once they have resolved the reclaim, they should also reduce the amount (or it's like as if your still paying for the PPI all over again).
I would ask them as well to send a detailed written breakdown.

Please keep us posted, the best of luck.

Thanks for your reply. He has phoned the bank, was passed between different departments and not given any answers! But no surprise there! He has requested a break down of payments, so maybe we will get this sometime this week. Obviously, its great getting back his money but we need to know how they have calculated payments. we will see what happens, I will keeo you posted.

Hi, Just need a bit of advice please.

I have been sent a questionaire by HSBC, My question is do i have to fill out one questionaire per policy? IE: Credit Card and Loan?

Also looking through the form I cant remeber half the questions they are asking as they were quite a number of years ago, is it ok to tick the cant remember boxes or will that work against me?

Yes, fill out the FOS Consumer Questionnaire for each individual loan and credit card you are complaining about.
It's okay to tick the "can't remember" box (especially for specific dates), but make sure you detail all the reasons for complaint as fully as you can
    Inspiration and examples are here

    Hi there

I would complete 2 separate forms, so that they do not get confused, so take a photo copy of the other, I assume its the same reclaim questionnaire as on this site here.....

    Step 3 reclaim questionnaire......

    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance#step3

As long as you make it clear as possible on the reasons on why you want to make a reclaim, and just try to remember all you can.

    Good luck.

    Slooooow;)

HSBC routinely request the FOS Consumer Questionnaire be filled out for EVERY INDIVIDUAL LOAN OR CREDIT CARD
They even say in their letters
"The questionnaire is a vital part of our investigation and it may not be possible to respond to your concerns without it".

The questionnaire is indeed the one at the link you (and I) provided.
