    Hi please can someone give me some advice. My husband has received a number of cheques from Halifax for several loans. No breakdown letter yet just random cheques arriving in the post!! One of the cheques is for loan that is still running however he cancelled ppi 2 years ago. They recalculated loan then but according to my figures it sends like the amount of loan was to much at the time. Should the loan now be restructured to reflect what it should have been without ppi? It's disappeared off his online banking, this is probably a coincidence!! Thanks

    Thanks I'll give it a go. Would they have destroyed the agreement even though the mortgage was still in place 4 years ago?

    Well done on your success.:beer:

    I would write to the bank to find out what is going on, you are correct, that normally once they have resolved the reclaim, they should also reduce the amount (or it's like as if your still paying for the PPI all over again).
    I would ask them as well to send a detailed written breakdown.

    Hi there

    Good luck on this.

    Yes this can happen, yet it can differ from one bank to the other, I would not worry about that though, and just continue to make the reclaim, they should still hold at least some details and enough to investigate.

    If you do want any information/paperwork of the account, you can request for a Full Subject Access Request (SAR), this is an optional request for them to send you all the details they still hold on the account, you enclose the one payment of £10 cheque or postal order, and they have 40 calendar days to comply.

    Hope this helps, below if you want to request for a SAR, the template letter for this, and below again the reclaim questionnaire, as I always state, keep copies of everything you send for your records, as you may need to refer back to it again at some point, or if you need to complain to the FOS later on.
    The reclaim questionnaire was actually issued by the FOS to save time later on, complete and send to the business who sold and set up your account.

    I took out a £7000 loan in 2000 with beneficial/hfc,i'm sure ppi was involved on it even though i have no paperwork now.

    Due to relationship breakup went off the rails for a short time and stopped paying the loan,and within one month,and 14 days of missing first payment i was taken to court by benefical/hfc without me knowing about it(said i'd been informed by letter,but never received one). no surprise that i lost case, debt was now around £12,000. (loan plus court costs)

    debt passed onto restons solicitors...had a payment plan set up with them since court case of a set amount every month,and i'm still paying it today(most of debt paid off though).
    As i'm still paying off the debt would it be possible to claim ppi off it even though its a loan from 2000,and i only paid less than 12 months instalments on it,before loan account was closed,and it went to court??

    Hi aqua, yes you can still go for a reclaim as long as you have reasons to believe you were misold.:D:D:D:D:D:D:D:D:D

    I've been reading about reclaiming PPI on here for awhile & finally sent my claim to Cooperative Bank on 9 March which was acknowledged 15 March. I didn't have any paperwork as my loan was repaid in August 2006 (I'd had several loans since 1996 each refinanced into another loan with Coop) I knew I'd had PPI because a claim I'd made was refused due to pre-existing medical condition (also my other reason for reclaiming is I'm a Civil Servant with good sick pay/redundancy) Fortunately I came across a Credit Report I'd done in 2006 when I remortgaged, this gave some details of my loans back to 2000 so I just sent them a copy of the relevant information. I asked at the Coop Bank if they had any further details but they didnt but the manager was really helpful & just told me to include my Coop bank account number as they should be able to trace them from my account. She also suggested completing just one form but request all loans be considered. If in doubt about reclaiming like I was just do it, what have you got to lose, they can only say yes or no. Will let you all know how I get on hopefully in the next 6 weeks.

    Well my subject access request has good into tesco to get my ppi details as they changed computer systems last year and can't get it otherwise. The loan was settled post Sept 06, so just hoping that it will show the ppi on it and amount as the loan itself would have been taken out in 2002. Do you think something should show this...I have a current loan with one payment left as by taking this out I realised ppi did not give me anything more than work gave me.

    ALso going to santander for my store cards, should I send one questionnaire for each card? Again ppi was cancelled years back now once came to understand it all....but taken out in 98 ....so not holding hope because of pre 2005.

    Hi, we took out a joint mortgage with Chelsea building society in 2000 and moved it from them in May 2008.

    I have several statements showing that PPI was being paid, but no credit agreement so I sent them a letter asking for a copy of the agreement using the template, and received this reply "your mortgage was not executed under the Consumer Credit Agreement and therefore we are unable to supply the information you have requested", and the return of my £1 cheque. They included a copy of the Offer of Advance (4 pages) which don't mention PPI.

    However it goes on to say "for any information that you may need about your account, please call our Member Contact Centre on .....", but I would expect that if I call the number they'll give a load of waffle that won't make any sense.

    As I have the statements but not the agreement, I'm not sure what the next step is. I've read on here about a SAR letter but as the agreement was taken out nearly 12 years ago would this help?
    Some MPPI is not reclaimable especially if this was a stand alone insurance and not included in the mortgage monthly payment, post the question here

    They have more knowledge regarding MPPI, if you do not have a claim for mis sell then this will save you time asking for the agreement.
