    no it was an apartment complex. the letter says that altho i was parked in a vistors bay (while i was visiting friends obviously) i didnt have a permit??? dont really understand how this works and how the landlord has lost anything by me being there?

    So, in essence a car park where no charges are payable for parking, which means the loss to the landowner is.................ZERO!

    So any damages are.......................ZERO!

    Which means their claim is for an unenforceable penalty which they have no legal authority to claim.

    As said before, don't respond to them, unless you receive properly stamped court papers. If that does happen then you know where to come for help.

  • hey guys i dunno if any on here knows but 5 people from swansea dvla have been sacked in breach of the data protection act. is there any way to find out if my details given to the parking company that keep hassling me were illegally given???
  • Unfortunately, parking companies obtain details from DVLA legally. Haven't seen that story yet, but won't relate to your case. Keep on ignoring, Tasha!

    Not new news as such. These five people have been sacked in the last three years and don't seem to be connected to each other.

    The dvla sacking have nothing to do with this, I am led to believe that it was dpa issue, no data went external from the dvla or so the say.
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

  • hi im back! lol just recieved a letter from roxburghe debt collectors. i played snap with the other debt collector letters posted on here but this 1 is signed by steve dargonne and it has a bold sentance saying 'we would like to draw your attention to common law doctrine of the law of agency which confirms the RK is liable for the acts of the agent (driver)'...what the hell is doctrine??? lol

    Don't worry about doctrine, he is talking total rubbish about the RK being liable for the acts of the driver.

    Its doctrine that doesn't apply to the scenario of private parking.

    If it did then the BPA wouldn't be lobbying for it to be included in the Freedoms Bill. If it were already law, they wouldn't need to.

    They are trying to say that they can form a contract with the registered keeper by virtue of forming a contract with the driver with no knowledge of the contract being held by the RK.

    Utter utter drivel. And a misrepresentation of the true legal position. Complain very strongly to the CSA about this deliberate attempt to mislead you about your legal position.
