Parking Charge Notice

Hi, I recently was given a Parking Charge Notice by a company named parking eye. The ticket states I was only allowed 2 hours parking for free. But I accidentally stayed for 2 hours and 45 minutes. The company have told me that I must pay £50 before the 29th February, if I do not they have said that I will have to pay £80 by the 15th March and £110 from then on. My daughter is disabled and she is a blue badge holder, I was parked up in a disabled bay, I was wondering what my rights are and if I should pay up? Any help would be much appreciated. P.S. I was not driving the car although I am the registered keeper, they state that it is private land I was parked on although previously these bays were free as the shops are directly in front of them.

Hi, I did have a look at it but I'm only an amateur really and would like a little bit of advice as I don't want to be out £110 if I do have to pay. Thanks for your help though

Ask them for photographic or video proof that you where parked there if you are worried and if they cannot provide any ignore them as it will be your word against theirs
If they can provide photo/video proof, go to the council and ask them if this company is authorized to police these parking baysAny advice I give on these forums is my own opinion only, and is what I would do in your situation or, what I have done in the past, please do not slate me for offering what I see as "sound" advice.ThanksDavewinston0 -
If they enforce on behalf of the council (council owned land), then pay. Hi, just rang the council and they have told me that they have no jurisdiction over parking eye as it is private land. Should I contact parking eye or should I pay or should I do nothing at all? Thanks for all the help so far has been brilliant.

You have two choices : pay or Ignore them, if you choose to pay you will also need to chose to ignore them as well as they usually come back for more money as they run a separate late payment scam.
The legal position is this:
English law states you must not suffer harm or loss:
If the landowner claims to have suffered a loss by your actions they may sue in court.
If it is £10 to park, they may sue you for £10
As in this case it is a free car park there is no loss so any charges are a penalty which private companies can not charge BY LAW !
In fact blue badges have no authority on private land and the disability act does, that states that the land owners must make adjustments to allow you to use the land, if they allow normal people two hours to shop then it is fair comment to say disabled persons require a bit longer, so they are the ones who have broken the law, not you.
I will however let you in to a secret, scam companies like this target the sick, old and vulnerable, for they know they are more likely to fall fo it.
The best advice is to IGNORE them, get ready and prepared with all the letters to expect, fake debt collectors ect, they can be viewed on the stickies, one by one they will arrive, a bit like a readers digest pester mail chain.

Does the same law apply in Wales? I did think two hours was unfair as I am disabled also but my daughter more so than I as she has a heart condition. Again I cannot thank you all enough for your help, I shall get ready for the barrage of letters. Aren't the council failing in their duty if they are failing to monitor these people and the threats they put people under, especially the vulnerable, as they stated that they had 'no jurisdiction' over the company? Will let others know about this very valuable piece of information, Thank you all very much
