TBH I actually sent the letter but due to having visitors I didn't get the letter off until Monday. Due to the level of speed that they have got back to us - I'm expecting something from Mr Ball tommorrow. If not I'll give him a phone call see what he has to say for himself.

Mr Ball has decided to give me the full refund including all the interest. :j :j :j
As I mentioned previously, my total claim was for £260 plus £35.92 for interest and he has agreed to pay the full amount ... without prejudice of course.:whistle:
Apparently he had to discuss the issue with his manager who has "exceptionally" agreed to increase their goodwill gesture from £150 to £295.92.
The beauty of this is that I hadn't even applied through MCOL. In my last letter I wrote this line in...
" ... I will now settle only for the full amount of charges of £260 + statutory interest of £35.92, Should I apply to the court I will also require this court fee to be paid."
I think the bit about claiming court fees back made sense to him. He knew that he would be paying the full amount plus the interest if it went to MCOL plus a further £30 for the fees. Probably a case of pay it now or pay more later.
I'm really chuffed in the sense in the two claims I've made - without going to MCOL, I've been able to claim some or all of the interest back.
As for applying for others .. Already HSBC is done and dusted (£1600 plus), Natwest - both Current account and CC account have already been approached (early stages), Cap One (statements received and LBA 1 is sent - still waiting:mad: ), Still looking at Morgan Stanley x 2, Virgin have totally ignored me as yet :mad: but they still have a few weeks before their deadline.
Then the two I am most apprehensive about are Barclays (also Monument) and Lloyds (I shall send some feelers to them next week).:D

I've sent Mr Ball a letter back saying that I reject his offer and I will be looking to progress my claim for the full amount through the court, however I'm prepared to settle for the figure claimed now, before further interest and court charges get added on.
I'll update this thread when I get a response.

Just giving you another update. I sent off the acceptance form today but where it said about this being a "full and final claim against the bank" - I crossed that out and put the words "for the amount period claimed for".
I also phoned Marbles and spoke to our friend the now infamous Mr Ball. I explained that I have accepted the offer with my own conditions put in. As I have a £0 balance at the moment - I asked him to transfer the funds immediately into the account and I would do a balance transfer as soon as it was in their (for me this is the quickest option to get another chunk of debt paid off). I gave him my mobile number to phone me once he's done this. The funds should be in my account by Wednesday morning. :T
I couldn't resist it - I asked him if he's been busy with these claims- he said that since the new year its got a lot busier.:whistle:
With regards to the other institutions - as there are existing general threads on these - I just post on those. Also I had my 6 years of statement back from Natwest and I was amazed at the amount of charges I had paid on this account ... I couldn't believe it ... in a total of 6 years ... £14 ... :rotfl: :rotfl: :rotfl: :rotfl:
I'll just phone them up and ask them to refund the money - rather than me go through the whole process - has to be worth a try

I'm surprised at my totals actually, in 6 years, across 9 different accounts I've paid a total of just under £600 in charges - with the interest, the total I'm claiming comes to about £850

Just a quick update - they can't find my acceptance form! James Ball is off work this afternoon as well so I have to phone back tomorrow. I thought it was too good to be true for such a speedy settlement. I'll speak with him personally tomorrow to get this done and dusted.

I'm just about to go through MCOL for my claim against Cap1 and just had all my Natwest CC statements through (£275 + Interest).

An update.
After phoning yesterday they called me back at almost close of business to say that they had found the acceptance form .. "it was in another pile James has" (?!). They then said that they will wait for James to get back on Friday to look at it. I said that James had already said that as as soon as it comes in he will credit it to my account - I think a supervisor was listening in on the conversation and said that they would credit immediately.
Today I phoned and the credit was there so I did a balance transfer to the sum of the credit and this was transferred at nil charge as "it was my own money". The transfer should take no more than 5 days - quicker then me being sent a cheque - then cashing it - then making a cash payment to a credit card.

Yep, letter arrived this morning from Mr Ball saying that he was sorry that I found his offer unacceptable, he's spoken to his manager and they "exceptionally" will agree to refund me the full amount asked for.
I've got to sign that I'll take no further action against them and then a cheque will be issued.
