Car damage at the work car park!!
Comments

You aren't forced to use the car park, neither are you aren't forced to travel to work by car.
Did they think to call the Police at the time to report criminal damage? Might have caused embarrassment for the hospital at the least.
Does anyone have a grudge against your friend?British Ex-pat in British Columbia!0 -
We have been forced to use the car park as the they put double yellow lines every where else on hospital premises and we are not allowed to use visitors car park. Parking around the hospital is not an option as it is a residential area and staff had their cars damaged in the past (paint stripers, scratches, smached windows...ets) by angry residents...I live 25 miles away from the hospital so public transport is not an option
Nevertheless, you aren't "forced" to use this car park.
You have the choice. Your empolyer certainly hasn't forced this on you!
Many of us have to find (and pay if necessary) our own parking spaces every day!0 -
i think your m8 will have legal cover on his insurance ,i would be talking to them ,just because there a sign saying left at your own risk do's not mean you cannot try claiming ,you never know, might pay out ,i could be like the private parking fees you see in the sud forum off this sectionthere or their, one day i might us the right one ,until then tuff0

Your colleague should bear in mind that if he/she approaches their insurer like this then this incident will go on their record as a loss and have to be disclosed as such for the next 3/5 years (depending on the length of history required). This may have an impact on future premiums.0 -

Sorry but what choice do we have? if there are no car parks nearby, and this is the only option available what can we do? Obviously we need to come to work...it is different from what you are suggesting as I am not talking about parking when shopping etc.0 -

No.
You misunderstood.
I was not referring to shoppers having to find/pay for carparking daily.
(It's not a right of employees to be given a parking place by their employer)
So what do you have to do in these circs:sam1970 wrote:
Also there is no guarrantee of a parking space0 -
and regarding claiming on the insurance, I appreciate that it is possible but why should my friend have to do that and pay higher premiums for years to come? Clearly the hospital should have some responsibility for damages happening on its premises...what would you do if you were a hospital visitor and your car gets damaged at the hospital car park you have paid to park in?0
-
given many people pay for parking
does that mean you are covered by the parking providers at all times, else they are negligent?
No but if its a site that is manned with staff who patrol it then there is possibility that a claim can be successful.
Unmanned sites speak for themselves. There is no staff there so you take your own risks.
Sites with staff on to manage and patrol them are different. The staff are there to deter this sort of thing and when they don't do it effectively and this sort of thing happens..0 -
...my point is that we have been forced to use the car park, we pay for it with no guaranttee of a parking space and it is not secure!!so what are we paying for?
Well... you aren't "forced" to use this car park, so end of that!!
You say it's insecure, and no guarantee you can park there.
Then ask what are we paying for!
But who is forcing you to pay?? Seems a waste of money!
AS far as getting the hospital to be responsible for damage done in the car park, then your friend could try suing them for his costs.0 -
