2 things niggle me with the OP's case though...........mainly why her OH used a false name as he was (i assume) in the store she worked in and surely must have known that he'd be known.
Secondly, do they have evidence of her taking it back. Was the receipt a goldie and did the store she returned it to keep the receipt?
If they don't have any evidence of her being actually aware of his actions in any way then really its a matter for Tesco to take up with him imo and not her, after all this isn't a criminal matter, they simply don't like being stuffed by their own policies. They can't hold her responsible for someone else doing that provided she can't be shown to know about it.

Sorry if I'm repeating something that someone else has already said (I haven't read back) but IMO the beauty of JTD is when there's a specific promotion on ... like:- £5 off £40 spend cos basically with a good JTD you're spending £40 - JTD to get the £5 off next shop
- a £10 meal deal where in fact you're getting 3 courses plus a bottle of wine for £10 - JTD (which could be as much as £4-£5)

you are quite correct to point out that employees should be treated as customers and entitled to DTD -i do not remember reading about exclusion regarding employees or immediate family members re DTD.
However, it depends on the intent and history (these are among the things which would be considered or brought up in a tribunal/court tesco decides to pursue it)-
INTENT:
-providing fake name and postcode
-returning the phone to a shop 25 miles away
HISTORY:
- i think the OP has posted about previous DTDs..it depends on how many was done and whether these items were all returned.
unfair dismissal - not sure if you have good grounds for this correlation can be proven... i am happy to be corrected is someone know better.
I've had a look at the OP's previous posts and I don't like the fact they have done DTD's before and used their privelege card. They will use this against them for sure.
Intent....the OP didn't give a false name so no intent by her at all. She wasn't even there.
If it were me, I'd be tempted to go along the lines of.....I'd had a couple of DTD's before (meat and baby item)...OH saw phones and did those without my knowledge not realising it could get me into trouble. I went mad at him for it as he'd given false name and addy so paicked and took the item back for refund. Offer to repay the money or offer it to charity.
Annoys the hell out of me as so many Tesco managers are bent and abuse their positions. I could recount literally dozens of examples on here of things I've aactually witnessed with my own eyes. As usual though, those in senior well paid positions get away with it and the lowly ones suffer.
