everyone does it ebay is full of higher price stuff theres no law against buying and re selling .. if you are that bothered tell him you arent selling to him to sellit on

Hello again Tojo Ralph- you are quick on the old keyboard!! My guess is that either the customer who contacted us let him know that they had, or he is seeing some worryingly familiar information appearing on here!! Given the responses maybe he got the idea from these very boards!!

I agree with most posts on here
1) your turnover is increasing -whats the problem
2) your product is therefore finding new buyers and if you have any market sense you would but your company details in with the packaging for potential repeat orders
3) refuse to sell to him if its a problem
4) set up your own ebay site - postage free and undercut the sellar
5) make him a distributer - saves you marketing.
I know its not right for someone to profit for a companies hard work but unfortunatly thats life - ebay wouldnt exist with out people quick enough to fill a the gap in the market.
If it worries you that much opt for option 3 & 4 and jump on the band wagon. Hes done the groundwork for you and openned your eyes to a sales market your company didnt even think of, so thank you very much and its dog eat dog so Ill only despatch to invoice addresses and Ill plug that sales hole and use it myself.
Always look for a postive in a negative - there is always one to be found.

I think you are right Greeneye, although actually I was asking for advice on the legality of the situation rather than an onslaught of people telling me that ripping people off is ok.
I am perfectly happy to concede that people here disagree that this is morally wrong, but as I have said it saddens me that everyone was so quick to jump to this guy's defence on a site which I have always thought was supposed to be about protecting consumers from people perpetrating this kind of behaviour.
In terms of people not wanting to buy from our site, that is very much not the case - the brand is carried in many high street retailers, and we make plenty of on-line sales which is why I would rather lose the money than see this guy profiting from abusing our brand and our customers. Had he approached us I would have been more than willing to agree terms with him and then everyone would be happy!
It is all very well to say that people should do their own research, but how many people discovered the law about reclaiming bank charges on their own? Or council tax rebanding? Maybe I should have just posted a warning that people might be paying over the odds and left it at that, but I was hoping people on here would consider the consumer in all this rather that the rights of the seller - as you say, I was looking in the wrong place.0 -

The only thing he's doing illegally is copying your text. Without your rights to resale being asserted, there's nothing to stop him selling on.

Yep I think some of us tend to be a bit more ebay (i.e business) orientated than much of the rest of the MSE forums over here.
Although we don't like seeing buyers ripped off by the scamsters so give advice to that effect.
There are ways to mess this seller up which have been outlined but if you are a business rather than a charity maybe "If you can't beat them join them" might be a mantra to consider.. although I appreciate you have a brand loyalty to maintain.
But a seperate ebay section of your business that doesn't have any obvious connections to your main business might be worth considering. And if you do have moral issues with this why not list on open auction rather than BIN and let the market decide.
oh and BTW I did the council tax rebranding thing last night and seems my whole street is two bands too low...:shhh: ;+)0 -

Thanks Greeneye - I think maybe I should have just vented on the appropriate board and left it at that!! Just had a message from our CEO about the e-bay shop thing though, so at least I might get some brownie points if it all works out!
Good luck on the CT re-banding - was astonished at how quickly the VOA web-site crashed when the programme was on so am assuming that there are loads of happy money savers fighting the system!!0 -
