not quite. For 5 months, you claimed Income Support and the state provided for your child. Any money your payment paid you during this time should have been declared and deducted from the IS you received. If this did not happen then there has been a mistake.0 -

on what grounds thesaint? From what the OP is saying there has been an overpayment of benefit - either by failure to declare or by way of a mistake which has been acknowledged.0

I will explain why I apologised.
The O.P. has been accused of benefit fraud. The O.P. made it clear on more than one occassion that she told income support about her circumstances.
If Income support have made a mistake, the O.P has received money that she is not entitled to, but has not committed benefit fraud. I do not expect you or anyone else to agree with me, but the O.P seemed genuine in her attempt to receive help on this site and has been accused of committing fraud which I find to be without base.Well life is harsh, hug me don't reject me.0 -
Agreed and this was put into a few other posts that there would be an overpayment which may be written off, but the CSA can't do this - it has to be Income Support if they prove that they were in receipt of all the relevant info.0

I doubt it Zara! Anyway, you were absolutely right in the main concept in there being an overpayment and not being allowed to make private agreements. There quite clearly HAS been an overpayment which the OP needs to sort out. Unless the CSA have evidence (or Income Support) that she did tell them everything that she says she did, she will have to repay the money. I hope that she kept evidence of exactly what she told them - amounts etc and dates that the money would be paid.0

Kelloggs, can I just say that I was the 1st person to reply to the O.P.
The first thing I told her that if she is claiming certain benefits, she doesn't have a choice where the CSA are involved.
