He would have got it back from the CSA anyway eventually, so neither the NRP or the PWC would have lost out. However, the CSA are never happy to pay advance payments to the PWC when they have assessed the NRP, so if the NRP doesn't pay, it is always the PWC that loses out whereas if the NRP overpays, the CSA refunds them, so again, the NRP doesn't lose out.
What would make the Government actually want to get the money back, would be to ensure that all cases where there is a positive assessment, they pay the PWC direct and claim it back from the NRP as they do now; but it may gee them up with regards the non-payers as they are actually losing the money, NOT the children as they are now.0 -

Yes, if they are underpaying they pay it over time so it isn't a big shock to them! Of course they ask for it in one go as there are some who have put money aside whilst the assessment is taking place, but for those who don't they always make an agreement to pay it off so the NRP is the one who benefits here as they get to pay over time, whilst the PWC has already had to wait, and has to wait even longer to get what is owed to her.0 -

Maybe, but it's a moral thing really and many, many people just won't face up to their responsibilities. If they did, we wouldn't need anything like the CSA! But that is in an ideal world.............0

Now i'm only guessing here so it might be really random(usual for me) perhaps they have a joint account, or the ex is actually writing cheques out in the new boyfriends name hmmm.

Do you remember how much you received in IS as you may be able to work it back if you were overpaid. If you have been I think this will bounce back at a later date so perhaps best to do the sums now.
jellycat-I also can't work out how your OH ex is putting the cheques thru her bf bank account. If she has a joint a/c with him and you've reported it then hopefully it'll all come to light. If your OH is paying the cheques in someone elses name then please don't. Some years ago my friend told me that her OH had decided to pay the maintainance money into his kids accounts as his XW was winding them up about what she spent the money on, I told them not to do it, just ignore XW but they didn't listen. These kids are now grown up and the CSA still say they owe the money for this period of time as the money wasn't paid to his XW. They are now having to pay the money all over again, what a shame they wouldn't listen.0 -
That's right Spendless - the money has to go to the PWC regardless of what the NRP wants - they usually argue that the PWC wastes the money on themselves and not the children blah blah blah, but it isn't up to the Government to determine exactly WHAT the money is spent on. If the PWC gets the money then either directly, or indirectly the children get the benefit of it.0

What happens if the parent with care is on benefit?
If the parent with care (or their current partner) is claiming either Income Support or income-based Jobseeker’s Allowance, then CSA is automatically involved.
In this situation, we make a full maintenance calculation using our standard process. However, the parent with care will not receive full child maintenance payments as well as their Income Support or income-based Jobseeker’s Allowance, as the government keeps some of the money paid in maintenance to make up for the money paid in benefit.
Instead, they receive whatever benefit they are entitled to plus a child maintenance premium. The child maintenance premium can be any amount - up to £10 a week of any child maintenance that the non-resident parents pays to us.
If your children are living with you, and you are claiming Income Support or income-based Jobseeker’s Allowance, you will be automatically referred to CSA and we will request information about the non-resident parent.
If you believe that contacting the non-resident parent may put you or your children at risk, you can ask us not to proceed.
However, if you do not have a good cause or reason for asking us not to contact the non-resident parent, and you do not you give us information about the non-resident parent we need, your benefits may be reduced.
What happens if we already have a private agreement, and then the parent with care starts receiving benefits?
If you have already set up a private agreement for child maintenance and then the parent with care starts to receive benefits, you must tell Jobcentre Plus and CSA about it. This is so we know how much maintenance is being paid and how payments are made.
