CSA but ive never claimed??

Hi All

Im in a bit of a dilema - my bf has had letters through the post sayign he owes me £900+ of CSA but ive never claimed it - me and bf have been together for the last 5 years and when we lived in seperate homes still i had to claim income support and i specifically said no i didnt want the CSA involved as he was providing for his child and we had an arrangement between ourselves adn we never heard anything from them until 6 months ago when they said he owes me £900!!!

Hes also has a letter saying he owes his ex girlfriend nearly £1000 for their child but he was paying her £80 a month in cash when he went to collect hsi son - not that i expect her to stand up for him in this matter as shes a bit of a money grabber - either way they are now threatening court action and possible imprisonment if he doesnt pay it - hes not workign and i work 11 hours a week

any idea what we can do?? he has told them he was paying his ex cash and that i have never made a claim for CSA as ive never had to - he lives with me now so there was no point payign the CSA £100 for them to give me back £80 when i lived in the same flat as him

can anyone help or have any ideas what to do???

    If you are claaiming certain benefits, you do not have a choice if the C.S.A are involved or not, it does not matter whether you have an agreement or not.
    Whether you fell in this category, someone will be along to confirm this or not.

    On the subject of his ex, He will end up paying twice for this if she says he did not pay her. If she has not been declaring the maintenance she has recieving she would be foolish to admit it now.
    Did he take £80 out of his account the day that he paid her?
    Since he knew that she is a money grabber, he should've covered himself by paying by another means, it's not a new unknown thing the dilemna he finds himself in.

  • Were you reporting the money from him as income to IS, if not they may be claiming it back into the benefit to cover the money you have already had.

  • My OH pays his ex with cheques but she clears them through her bf account as she does not have a bank account. She does not declare the payments and is claiming IS. I have reported her for this but the Benefit Agency have done nothing to check up.

    So in theory this could happen to my OH too!!!!

    How does the boyfriend pay in cheques made payable to someone else through his account? I hope your other half is not making the cheques payable to the boyfriend_pale_

    The DWP are not allowed to tell you what action they have taken. If she wants to carry on what she is doing, let her.
    Worry about how your boyfriend covers himself if she makes a claim that is untrue.

    So in theory whilst you were claiming income support you were also getting cash in hand for child support, did you tell income support of your little arrangement?

    Regarding the ex well as he has been paying her cash in hand also there is no proof and he could still be liable.

    So your other oh writes the cheque out to whom :confused: the PWC or the boyfriend, if he is writing the cheques out to the boyfriend then how does that work. You say you have reported her to IS for getting IS and seperate payments from your bf why don't you just stop paying her the extra money and contact the CSA, if you want to do everything legal and above board, then at least your bf has proof that he is paying to support his child and doesn't get a nasty shock in a few months.

    Thats probably the problem, unless you declared this income then it would be assumed that your b/f wasnt paying you anything and the CSA would then be involved to reclaim the money back from him under the rules of IS.

    You need to provide proof that you were taking money off him to the CSA, but if you havnt declared this to the DSS you will be in a lot of trouble and will possibly even have to pay the IS back :o
