    Just wondering if anyone has an insite to my situation:

    Overdrawn (I could clear this is a couple of months)

    I could reclaim £897 plus interest £862(the calculator on the site is a fantastic tool)

    The thing is that I have a credit card with the bank also owing over £1,000

    Are HSBC likely to close the account and the credit card account and ask for everyting back now???

    Going to post another thread also my financial adviser is getting me sorted and has given me a really good solution..

    Well, Well, Well, I go over my overdraft limit for 1 week due to my car costing more for repairs and despite me explaining to Barclays that I have money to cover this but cannot pay it into the account for 4 days (I've had to apply for this money via post), I'm told by Barclays that they cannot increase my overdraft but they have charged me £90 and so increase the overdraft further. I'm really annoyed at this and will tonight send a letter to them requesting information about the last 6 years of charges. I don't think there is many as I rarely went over my overdraft, but its such a slap in the face as I've been with them nearly 10 years. I've had poor credit in the past as a student and so which bank account should I use if I have 'parachute'? Any ideas?? Thanks. Oh my overdraft is £575, £500 is authorised!!!!
  • Iam in a strange dilemma, I had a largish overdraft debt with the bank, I became unemployed and unwell and they closed my account and it went to credit management stage, I was still paying a token amount towards it.

    When I got wind of being able to reclaim unlawful fees, I began Martins process, after many letters I finally got a letter saying, that they would be prepared to remove a third of the debt, which is what I had asked for, which is great.

    Now the big but is - am I in my right to ask for a cheque for the value, rather than having them reduce the debt to that value?

    Hi everyone, can someone give advice when on incapacity benefit and have a bank charge?
    I went overdrawn with my TV license and another small DD from my account on the 31st, my IB went in on the 1st but they returned both and charged me £70!!!!!!!!!
    I use internet banking as I don't go out often and usually check every day to make sure I'm within my £150 overdraft limit but I didn't check that day and therefore incurred these charges. I was really worried as this is a lot of money to me at the moment so I called the bank to ask them if they could please refund as it was the first time this has happened (in years), after the call centre reluctantly put me through to the branch I was close to tears feeling I was begging for the money. She said she could refund one of the £35 but not the other so I explained that I was sorry but I wasn't too well at the moment and as it was only one day could they consider cancelling the other, again she said no so I asked to speak to the manager, by this time I was in floods of tears and trying my best to hold it together whilst holding on for the manager, she spoke to me very abruptly saying I hear you're on complaining about charges!! I said no I was merely asking them to refund the charge due to the circumstances mentioned above, she kept insisting that it was my fault and that they wouldn't refund it, at this point I couldn't control myself and was crying so much I had to say sorry i have to go and put the phone down.
    Funny thing is my boyfriend was overdrawn a couple of months ago and all he did was call the call centre and ask for the charges to be cancelled and it was no problem!!!! Why are people on benefits treated so badly, I actually used to work for the bank in question and if I treated a customer in this manner I would have been pulled up about it.
    What would the best move be now? Any suggestions.

    Ok im new here, i have read the article but am still a little confused, my son started off with a small overdraft whilst earning £30 per week on a apprentiship work based learning course, when that all fell through and he was left claiming benefits he started to get into debt with his mobile phone company and asked natwest to defer his charges that month instead they extended his overdraft and this happened again and again he now has a overdraft of £450 and goes overdrawn every single week, so of course he is in tons of debt with the charges, will he be able to get a parachute account whilst in so much debt (he has a credit company chasing him because of a phone bill) and being on benefits.....is it worth him reclaiming, he really cannot pay the overdraft if they ask for it all at once, now he is on the verge of being homeless because he owes a fortune on his rent.....im so annoyed that the bank just keep extending his overdraft when its quite clear that he cannot manage his money at all...help!

    hi, Can someone let me know what to do when your acount is overdrawn because of bank charges? I have asked the bank for all my charges back, which covers the amount overdrawn. The bank has asked me to wait until the court case is done and dusted, so now the overdrawn balance has been passed to the collections department. Can i ask them to wait? If anyone could let me know a.s.a.p I would be very gratefull as iIhave to speak to them this week, thanks all.
  • I have followed the procedures with three letters the first asking for bank statements, second informing them that I want a refund of the bank charges, to which I received a reply saying that they would look into it and I would receive a reply no later then 4 weeks.

    4 weeks came so I sent a letter befor action to which I received a letter saying.

    "Thank you for your letter

    We have asked the Financial Services Authority to suspend the normal timetable for dealing with unarranged overdraft bank charges complaints.

    Until the banks legal proceedings with the office of Fair Trading are concluded we will not issue or respond to any further communications received fromyou (or a chosen representative) on this matter.

    we can assure you that your complaint has been registered and will be resolved as quickly as possible."


    I do have an overdraft of £600 that I owe £550

    So any idea's of what I do now???:confused:

    Should I clear it then write again???

    I am not sure if I am doing the right thing- or if what I want/need to happen is even possible, I hope someone anyone! can let me know if I am on the right track here.

    Ok the gorey details.
    I have just opened (about a month or so ago) an account. I am able to have a limit of £100 overdraft which is a Godsend as I rely on benefits which are open to incorrect and mistakened forgotten payments. I struggle on what I do have anyway but try to budget appropiately and dont do a terrible job.

    However, I have recently found I went over my overdraft, I only knew this as I went to look at my account online as my benefit giro had not come through and I was worried about how much -if any, I had left bearing in mind I budget for the giro to arrive and it had not. (missing in the post apparently). I was able to see 4 transactions of around £2 each bringing me over my limit by £10.

    Knowing I get charged for this even though it wasnt onmy statement, I called the bank who kindly reversed the 4 charges for me, so I didnt have to pay ther overdraft charges. I was very grateful for this and it was done as "goodwill".

    I then stayed on the line to hear another further 4 transactions were pending. I still cannot understand why the bank let the money come out of my account, why my card was not declined for example. Because these transactions were pending for the next day, unless I could wire money from an account from the same bank to mine for these transactiosn, it would again, go over my overdraft limit, Meaning that again I would end up needing to pay £135 in overdraft charges for the other 4 transactions that are in total £40.

    I cant tell you how much this is scareing me. I am on income support. I cannot afford this, I wish I could but I cant. I see many doctors and psychiatric people so I cant work full time (I do voluntary work) I try to do my best to make ends meet, I didnt mean to go over and had my giro arrived I wouldnt have.

    I spoke to the bank both in the building and on the phone, they said as I had already had one "goodwill" guesture the previous day, I was not able to have the same thing again. The fact is, I had the money to pay in the previous day but the banks were not open, because I had to wait for the next buisness day for the banks to be open, the transactions went from pending to being charged, therfor incurring 4 overdraft charges.

    I tried everything today to get them to override the charges, make it just one charge, reduce it, anything, £130 is more then I get in a week from benefits, I cannot begin to tell you how this is going to affect me- I literally cannot afford to eat. I am very worried by this as I am a recovering anorexic and cant really affors to just not eat for afew days. It will trigger things, I will relapse.

    Sorry if this essage goes on for so long, I dont know where else to go and dont even know is an application to reclaim the charges will help as I have already had a goodwill guesture for the transactions the previous day.

  • The Abbey (National) closed my account in 2005, with an £800 overdraft outstanding, due to a marriage breakup. I pay a monthly sum to a credit reference agency which, the bank and C.A.B set up to pay off the overdraft. I recently sent off my first letter to reclaim back my bank charges and the statutory £10 to cover this.
    My reply was a letter from Abbey to tell me that on the 31st January 2007 they had sold the account onto another agency and all future communications should be through them and not Abbey. Although my payments were to continue as usual. My £10 cheque has not been cashed to date.
    As I am on benefits and registered disabled, I have no means of paying off this overdraft and was hoping by reclaiming my charges that I could pay off all or some of overdraft.
    Now I don't know what my next step is? The Abbey just doesnt want to know.
    Please help me, any information will be gratefully appreciated.

    Wondering if you had any luck/ideas as to what to do. I am in pretty much the same position, only with Lloyds TSB. Only difference is my Od is £3800 thanks to Lloyds bouncing a £2.19 DD out of my account 4 times a day for three months and charging me £30 a time for them to do it, despite the fact DD was stopped. Anyway, was wondering if there was anyway of sending debt back to bank or claiming despite the fact they have sold account, as surely they are still liable to pay back charges??
