  • I have over £200 of bank charges from Lloyds tsb student account , ive sent the two letters now I can go to court,but the reason I haven’t yet is because they might give me the £200 and then ask for there £1000 overdraft fee back. Which I can’t afford at the moment.

    Lloyds tsb classic account are asking me for over £200 in bank charges and interest should I fight this, the reason im scared to fight it is because they might ask for my overdraft back

    Hsbc bank owes me over £200 in bank charges but if I go to court they might ask for the £1000 overdraft back, and cancel my agreement of hsbc credit and overdraft personal loan.

    Plus if I do decide to go to court I can’t afford the court fees because im in debt I know I can get them back but I still cant afford them.

    How much interest does the bank pay is it 8% a day or 8% for the whole charges added together.

    I am in much the same predicament as others, I would love to claim back my charges, but took out a large loan with HSBC at a fairly good rate last year and am worried that they will ask for me to pay the loan back if I start the claim, I understand that I should set up a parachute account but have no history with the new bank in order for them to loan me the same amount. Any cases or thoughts, has anyone done this with a current loan agreement set up.:rolleyes:

    Sorry to bore you if this has been questioned elsewhere, but I feel it's a valid question for debate/answer for many that may be in a similar situation as me.

    I/we have 5 Lloyds TSB accounts, 2 x current accounts, 2 x credit accounts and 1 loan account. I/we do not bank with Lloyds anymore due to their charges and attitute to people who find themsleves in difficulty. However, our accounts are open as there are outstanding overdrafts etc that need to be re-paid before we can close them completely. Our Lloyds accounts are covered under repayment agreements with CCCS but I'm afraid that if I/we start serving them with notice to re-pay bank charges (and theres a few thousand!), they'll close ALL our accounts. Even though we have opened accounts with the Co-op (parachute accounts - I think) they are basic accounts and we have no access to overdrafts/cheque books/etc etc. Therefore if Lloyds do close our accounts, where do we stand with transferring (where I have no idea!!) or paying back the outstanding balance of our overdrafts etc?? Could Lloyds send the bailiffs in even though we're making every effort to repay the debt (CCCS)??

    Is anyone else suffering the same fate? or problem?

  • But according to Al Mac et al, all the bank charges are your fault anyway hey ho, you've been living beyond your means even if you've just been trying to pay the mortgage & feed your family.

    No problem with that Al Mac, they can have it. It will certainly go to pay off overdrafts etc. What concerns me is any deficit ie I owe them £1000, they owe me £700, what happens to the £300 if they close my account.     MM, I appreciate what you're getting at but you need to chill somewhat. My/Our debt has been created by ex partners/children/ other means and finaly our own crap. If Al Mac is hinting that it's all our own fault? then I'm sure he'll also appreicate it's not always.

    There are always !!!!!!!s on sites like this. It's a site for opinion for and against and folk will state for and against in every situation!! Don't get suckered in to the negative/do gooders. We live i the real world!!

  • sorry, *head bowed penitant* was just on another thread where i was taking al mac et al comments v personally, eg assuming i was in debt because of flash lifestyle, new car etc etc etc (yeah & i'm posting this in the Bahamas!) . Sorry again for hi-jacking your thread.

    I'm trying to reclaim some cash to pay back what i owe banks on my DMP. (almost makes sense!)

    Ahhhh the Barhamas lol, see my head is in the sand at the Maldives(Only been there virtually !!) OK Not in the sand now but firmly confused about about re-claiming charges. Can anyone tell me, if I still owe an account after the compensasion has paid out - the account closed - what is the position??

    As Martin has said above, he doesn't want to put people off claiming but you do have to be aware of what could happen and it would be very remiss of him if he didn't give this warning.

    Also please remember your claim may not end up in court and in fact at the end of the day it is your decision if you do decide to take it that far. If the bank make you an offer and you don't want to go to court then take the offer, its money you wouldn't have had back if you hadn't started the reclaim process.

    Don't be frightened but do be aware and good luck to all.

    Frosty_box, I love Frosties by the way, please have a read of this thread regarding claiming while using CCCS as Martin has spoken to them regarding this and there should be some help/answers for you there. As you have several accounts my recommendation would be to keep each claim separate and then any refund monies would go into that particular account.

    Please don't be confused just be aware and read up all you can.
  • I have recently finished uni and as a result have accumulated a debt of £3000 with Barclays. A lot of this debt is built up from charges and i would worry about the bank closing my account if i was to try and claim, although this has alrerady happened about two weeks ago. I have been forced to pay this back over the next six months and dont even have any income at present. I would like to claim back charges but i am not sure this is still possible.
    If anyone has any advice it would be most appreciated as looking at the other posts everyone seems to have a good grasp of the subject.
