  • Frosty_box, I love Frosties by the way, please have a read of this thread regarding claiming while using CCCS as Martin has spoken to them regarding this and there should be some help/answers for you there. As you have several accounts my recommendation would be to keep each claim separate and then any refund monies would go into that particular account.

    Please don't be confused just be aware and read up all you can.

    I've already written to one creditor to test the water. Theres just so much to read!! I will take your advice and write to Lloyds regarding individual accounts and not lump them into one. If I do get anything back from them, then they are welcome to it. Anything to reduce what we owe :rolleyes: Frosties: sweet like me :p

    Any monies you can claim will be put towards this debt by the bank.
  • I'm guessing there's no definitive answer to this really but hoping for a bit more advice. I'm a post-graduate student and have a £1700 overdraft with Barclays. They charge me £30 everytime I go over my limit by anything more than £5... I only ever go over by about a small amount. Obviously I'm not working so I'm thinking it would be near impossible to swap to another bank with this kind of overdraft.

    I feel like it would be unwise to try to claim back about £150 or so but I could really use that money. What do you think? :confused:

    Does the A&L account mentioned in the article need to have money padi in (parachute account).As my wages go to YB but I OD by about £1500.

    I'm rather worried as i am now on my third letter with my two accounts with Lloyds tsb and whilst they have not responded except to send me 30 envelopes with my copy statements in i have recieved a letter last week demanding repayment of my overdraft. So i would love to follow Martin's tips now i have read them but unfortunatly i was so incensed that i sent off a rather sarcastic and childish letter mimicking their bank charges letters. I am worried that this will now weaken my claim and rile them more. I have pasted the letter below - does this weaken my position legally? Anyone know?

    Thank you for your letter dated 22/03/07 issuing me with a formal demand that I repay my current debt to Lloyds TSB Bank PLC. I note that you request a total of £564.15 be repaid which includes my agreed overdraft which was not up for renewal until October this year plus interest and bank charges. I also note your intention to charge me interest on this amount until it is repaid in full.

    Coincidentally I have also written to your customer service department three times in the last two months and am currently in the process of making a claim against Lloyds TSB Bank PLC for slightly in excess of £2,000 in illegal bank charges (although with the £277 I have been charged on my second account in bank charges this month this will increase). This I believe provides a perfect opportunity for us to bring a mutually beneficial conclusion to our relationship which has been in existence for the last 22 years.

    Unfortunately until Lloyds TSB Bank PLC has investigated my complaint and repaid these charges I will be unable to make the payment requested. If this request is sent to me again upon repayment of charges, I would be happy to make full payment provided you had credited either of my accounts with the full amount illegally charged. I would appreciate it if you could inform me of the rate of interest you intend to charge me on the £564.15 so that I can apply this rate to your outstanding debt to me.

    Let me reassure you that I am keen to help you sort this out. If you call me there may be a way I can help you identify the relevant charges and therefore resolve this issue. Until then I will not pay back any monies owed on this account until you repay enough money into either of my accounts to cover this balance.

  • The Abbey (National) closed my account in 2005, with an £800 overdraft outstanding, due to a marriage breakup. I pay a monthly sum to a credit reference agency which, the bank and C.A.B set up to pay off the overdraft. I recently sent off my first letter to reclaim back my bank charges and the statutory £10 to cover this.
    My reply was a letter from Abbey to tell me that on the 31st January 2007 they had sold the account onto another agency and all future communications should be through them and not Abbey. Although my payments were to continue as usual. My £10 cheque has not been cashed to date.
    As I am on benefits and registered disabled, I have no means of paying off this overdraft and was hoping by reclaiming my charges that I could pay off all or some of overdraft.
    Now I don't know what my next step is? The Abbey just doesnt want to know.
    Please help me, any information will be gratefully appreciated.

    Can someone help me with this little question please. I am about £250 in the red, all of which is due to bank charges for an unauthorised overdraft that i never realised i had. I thought there was £10 in the account and i have not used it for about 7 years. Can i use the same reclaiming procedure to get the charges removed from the account even though they have not been able to get their grubby little mits on my money? I have started and sent off the first 2 letters and this has had no effect other than replies saying that they were not going to clear the debt and that if i do not reply within 28 days they are going to send in the balliffs.
    I hope this question goes in the right place.

    Oh dear, oh dear, oh dear! I'm in the process of reclaiming charges from my bank, Natwest and I have sent the second letter; however, I have a £2000 overdraft, no job and only incapacity benefit as an income. I just got Martin's newsletter this morning saying that it's likely the bank will want the overdraft paid back. I can't go to another bank, they won't take on the overdraft, as I'm not employed. I've even tried opening a basic bank account, but I've never heard anything from them, since my online applications. I am now rather sick with worry, so any advice would be much appreciated. I have posted here before, so am not completely new - I prefer to "Lurk" and read most of the time, which is why I don't often post. Sorry, I hope this is okay!

    because its a goverment benefit id open a post office card account.try 2 come 2 an agreement with bank say ul pay x amount a month.mite work.if ur on income support u shud get court action 4 free.good luck.im at court stage now.:eek: just gotta bite bullet n hope it dont bite back!
  • I have an account with rbs and due to a problem with t-mobile, i have exceeded the £350 limit of my overdaft facility and incurred charges of about £700. I have received letter claiming that they have tried to contact me over the issue which i know is not the case, in fact i have been trying to contact them but to no avail.

    however, i have now recieved a letter that they will be taking me to court if i do not pay the charges within 28 days. i was planning to start the procedure of claiming against them this week, but am now not sure if i am able to do this. i am not in a poisition to be paying this off within the next month as i am a student.

    has anyone been in the same situation or know what i should do now?

    also, if i do send the bank a letter, am i able to charge them the £30 that they charge to send one to me?
