There is nothing in the advertisement clearly stating the iphone is not included.

Although I agree and wouldn't use this trick myself, there is also nothing stating the phone is included so theoretically they got what they ordered.

In theory this is correct however clearly a customer would 'expect' a phone to be included.

The title does actually say IPHONE 4S 16GB (BLACK) BOX with ALL ACCESSORIES which suggests the item is the box for an iphone with all accessories included which it was.

I'm sure buyer will win claim but just wanted to point this out and why it is so important to read all info and if you are selling make sure your description is 100% clear. From me looking at that, it was the box for sale.

As long as you have outlined as you did above in your first post, then don't get bogged down with trying to resolve with him.

As soon as you can escalate do it. If you ring eBay, you may* be able to convince them to act, but only if you get Dublin and only then with a helpful operative. But it's worth a try for a chance of a speedy result.

Yep im going to contact them today. Should i message ebay regards to the seller buying this box then selling it on? Or should i also message it in the dispute page?

Johnnboy, normally I would agree, but the item is listed as :

    Item specifics
    Condition:
New: A brand-new, unused, unopened and undamaged item. See the seller's listing for full details.!See all condition definitions

You cannot buy a new unopened box like this without the phone in it.

Op, I would ring eBay first. Don't give the seller any info yet.

I agree with ur points. Though it is misleading snd deceptive as the photo includes the phone and is black. He should have said the phone is not included. From the looks of it 18 bids on the item so alot of people fell for it. Possibly because of the photo. I hope i win as its alot of money to just lose!

But this is where common sense should kick in. You are basically suggesting to simply ignore the suggestion that it is just a box for sale because it is listed as brand new and unopened. You cannot do that, the 'BOX' part of the description should at least raise a question to the seller so then if they do clearly claim phone is included then you have a record of it in form of a message.

If you are ever unsure on a purchase (on any site) then always contact the seller first and ask questions until you are sure. You cnanot just blindly order stuff like this especially on eBay!

I am not ignoring that fact. But the first few lines could be read that the box is also included, rather than only included.
    Brand new
iPhone 4s 16gb box with all accessories.

The lack of any punctuation makes a statement. So it is ambiguous (intentionally).

    Just like
    Brand new
VW passat 1.8 saloon 4 door sunroof all usual extras

I don't read it like that, I read it as you are bidding on a box. If it said 'boxed' then clearly that would be suggesting it was a phone that comes boxed but it doesn't, it says 'box'
  • This seems to be the ongoing issue with eBay, there are a lot of assumptions. I presume that you read that as 'boxed' but seller has made a typo and just missed the 'ed' from 'box'. If so then this is where problems arise, you cannot assume on there. There are a hell of a lot of people ready to take advantage if you do.

I think there is a definite intention to deceive here and echo th eposta above and suggest OP phones ebay immediately and keeps phoning them until they do something.

OP, start a folder of info about the seller as well in case you need it later. Take screen grabs of it all in case the photo is hosted somewhere online and can be removed. Make sure you check out sellers proper geographic address, keep all and everything about this transaction. This is one time, assuming you have a geographic address that checks out, that I would take to small claims if ebay find against you.

Talking about common sense, no-one is going to pay £400 for a box! If the seller was not out to deceive they would have realised the bidders were thinking it was a phone once the bidding got too high for it to be a reasonable price for a box!

Its deceitful from start to finish, plain and simple. The seller got stung himself so decided to pass the buck. I hope he gets banned for his lowlife stunt.
