Your other thread that you started this morning said you you received incorrect advice as to your consumer rights on this thread. The course of events does not represent you asserting your consumer rights, only that the company paid out to make you go away in a cost effective manner for themselves. These are two different things.

I am glad you got the outcome that you wanted though, that is the main thing.

Any consumer making a complaint or civil action against a retailer is a consumer asserting their consumer rights. if i didnt have any consumer right there wouldn't have been away for me to take such actions.

    thank you for you quote

Your definition of court action is a little wrong, for example I could take Tesco to court for not selling a particular set of pants, but I'd loose and probably not even get that far as it would be thrown out.

Although there may be no consumer rights, you can still go down the same route like there was.

Just so you know for the future.

    Hi Lisa,

Thanks for taking the time to raise your issue on here. I am sorry to read that you have experienced an issue with regards to getting your TV exchanged / repaired to a satisfactory standard.

If you would like to take a look at the email address in my bio you can email me with your complaint ref that should start with a CC and I will be more than happy to speak with Mr Holmes and hopefully get this resolved for you.

If you don't have your claim reference number you can just email me your full address details and I will be able to find your claim from there.

    All the best,

    Paul

    WHAT?

That is wrong, I can take Currys to court for not stocking trousers, I'd loose because there isn't a requirement for currys to stock trousers, but I can still go to court.

please why did you have to do that,
you said I did assert my consumer right and I believe I did. I had a faulty TV and the only option I had was for a repair. but now I have a new TV and my costs back so im sorry but I believe I have won

The issue is resolved, I believe it's the way it was handled that the Original Poster was complaining about.

Prehaps a public post isn't the best way to solve it.

Also L1sa, you won in the outcome, but your legal course was far from certain, like SomethingCorporate said, I'm glad you got the outcome you wanted, but you didn't win any legal battles.

when my solicitor asked them "what case law would possible help you in this matter because I am unable to locate any so please can you disclose which case law you will be using as a defence", they settled

So did you do it yourself, or did you have a solicitor?

You must have some series problems in your life to instantly jump to an attack like that, all clsmac was doing was giving me some advice, I phoned consumer direct and asked them if what you said was correct and you are totally incorrect .
For the first 6 months they have to prove it isn’t an inherited fault, but they have already said it is. Which gives me the right for an exchange or refund, not to be force a repair.

The word you meant to use is inherent. ;)

And why is "clsmac" answering your posts? Also, they logged on at 9.47am this morning, for the first time since January, and just before you posted.

You have me on that one!

Unfortunately the fact that they settled means we'll never really know whether you were legally in the right or whether they just paid up to make the problem go away.

It's a moot point, the only thing that matters is getting the right result and as I have said at least 10 times on this board is that the squeaky wheel gets the oil - whether they are right (by law, by morals etc) or not is irrelevant, getting a positive outcome for the consumer should be the real focus.
