Son Taking out Loans without intent on paying them back in our address !

Hello !
We don't know where to start,
We have had several debt collection agents come to our address in regards to 'Payday' loans he has taken out in our address, He doesn't work and hasn't worked for 2 years so how on earth is he getting credit ? He isn't on the electoral roll, Has never been on the electoral roll at this address (We've lived here 20+ years).
He owes money to around 13 creditors, We are constantly receiving letters addressed to him at our address (He was 'Kicked' out because of personal issues, He's 28 years old).
We have had two new letters today 1 from Wagedayadvance and another from speedy cash in regards to payday loans he's taken out and hasn't repaid ! (loans taken out within the last month).
Surely what he is doing is illegal as he is providing false information to obtain credit, He's obtaining credit through deception with no intention to pay them back.
He's also just made a claim for Jobseekers allowance on our address as well !
What should we do ? Phone the police ? This needs to stop, We are fed up of debt collectors, And we are worried that if a CCJ is issued against him them we will have court approved bailiffs at our door !
Surely National Hunter or CIFAS can place markers to stop him from obtaining any more credit ! Its unfair on us, And its unfair on these companies who are being screwed over by him.
I know its an offence to open someone else mail, However the law states, "A person commits an offence if, intending to act to a person's detriment and without reasonable excuse, he opens a postal packet which he knows or reasonably suspects has been incorrectly delivered to him."

As you say the last thing you want is bailiffs turning up at your door. At the moment he is applying online and using legitimate companies. God forbid he starts using loan sharks who will use any tactics to get back what he owes.
To be honest I am not sure the best way forward with this. As what he is doing is illegal, as he is providing an address where he no longer resides, I would contact the police and see what they can do. Isn't this a kind of fraud that he is committing?0 -
I know this sounds odd but......i would post this on the bankruptcy forum. Well technically speaking, he's committing fraud as he's pretending to live somewhere he doesn't in order to obtain monies that he has no intention of paying back. It's a criminal offence. As I see it, you don't intend to act to your son's detriment and your reasonable excuse is that you need to know what you are going to face at your door so you can deal with the consequences of his deceit. So no law broken.
But he is 28 years old. You should not be opening his post with you parental hat on. You are at least a decade past the point of doing that. You should only be opening it to manage what might turn up at your door. Most of what comes you should dump straight back into a post box marked 'no longer at this address'
If stuff turns up from a court, however, I would suggest that you do open it and return it to the court with a covering letter, copy to the complainant, advising that he does not live at your address and that he was kicked out. That should inject some uncertainty into court proceedings and hopefully preempt bailiffs.Hi, we’ve had to remove your signature. Thank you, Its the last thing we've wanted to do, We've tried helping him so much. He's took all of his stuff from our address, We have nothing...We've just rang our local police station, We've got to contact the creditors now, Will they issue some kind of Fraud alert on his Credit file to stop him from further obtaining credit ? The interest on those loans is astronomical.
You need to get him to agree to
1. Agree a payment scheme with all debtors
2. File for bankruptcy
Or you'll call the police.
He *will* get done for fraud.
I'd seek professional advise first though as any action other than him sorting this out properly will have lasting effects for him.
RE: loan sharks, there are specialist divisions of the MET that will help you with this. If you start to get calls/visits from them contact the police immediately.0 -

We would but most of the letters have no return address, Meaning they just get shredded anyway.
We've been told that it is acceptable to be opening his mail as we are doing it in order to contact these creditors to let them know the situation. He'd have to prove we where acting "to cause detriment or without reasonable excuse'', We aren't doing it to cause harm, We're doing it to stop fraud and let the appropriate companies know whats going on !
When and how does National Hunter and CIFAS get involved ? He has to stop taking out credit in our address full stop.
The police where very helpful, And have actually told us if it continues to contact a solicitor.
Its not just one or two loans, Its 13ish credit agreements on this address !! 13 which he hasn't paid, 13 of which could issue a CCJ, We could do without bailiffs at the door ! most of which he's defaulted on, Its unfair on those lenders dishing out money to someone who has no intention of paying it back, Its stealing. He still owes his previous employer money, And the housing association, and N-Power...The list goes on...Not to mention the local shop he's ran up a tab with.
Also he's made a jobseekers allowance claim on our address ! What do we do ? Contact the jobcentre to let them know its false information also ?

Why should they do all this? All they want is to make sure bailiffs or worse don't come knocking at the door. He's way past mummy and daddy helping him with payment plans and seeking professional advice to resolve his problems for him.
He's 28, he's parted company with his parents and he's deliberately using their address in an attempt to avoid paying his debts. What a charming son he sounds.
I feel for the OP, I really do. What a horrible situation. I'd probably just contact the police although they might well see it as 'domestic' or merely a civil matter.
I'd also advise every debt collector that he doesn't live there and it's harassment if they continue using that address.
