    In the template letter, you ask for a list of charges. This is fine, as it should provide all of the information you need for a claim.

    Depending on when the charges were incurred, they may be set at the new level (£12) since the OFT published their report (April 2006) on Credit Card charges. This does not mean you cannot make a claim for this amount though. The OFT figure was an amount they would not take action against the company at, not an actual calculation of their costs.

    I thought you could ask for the £12 charges back. What if you get £12 over limit fee charge and £12 late payment fee both in the same month.

    I am about to have a go on this one with Tesco:

    This year I got hit for the following for the same bounced direct debit into the account:
    31st Return Payment Fee £12
    1st Late Payment Fee £12
    7th Overlimit fee £12

    My line is that
    1) the penalty charges are out of line and illegal
    2) the charging of £36 for one return payment is a cynical attempt to work around the £12 threshold for action indicated by the OFT

    Yes - but it costs me a lot for them to make me proud!
  • I have written to Tesco personal finance asking for copy statements so I can check what I have been charged with regard to insurance charges however I have received a letter this morning from them requesting a cheque or postal order for £10 to provide this information are they allowed to do this?

    Yes - it is a fee they are allowed to charge under the Data Protection Act

  • Sent first letter to Tesco Personal Finance and just received a standard reply saying that the charges are in line with the Office of Fair Trading standards. Should i now send a further letter or not

    Of course, in court it's the law that applies not OFT guidelines.
  • I am slightly confused over what we can claim for. I recently applied to Tesco for a list of charges over the 6 years that I have been with them.

    They sent me a statement detailing all my late payment charges (free of charge), however most of the charges even prior to 2006 were for £12.00. There is only one charge for £15 in 2005.

    Can I still make a claim or the £12 charges deemed to be fair?

    Has anyone made a claim against Tesco?

    If you get it back after one letter then yes
    but I have paid out over £5 in recorded delivery letters to natwest and it did not get as far as the FOS.
    It could end up costing you more to send letters than you are claiming
