    No, you can put a car through an MOT anytime you like. In fact can put it through an MOT every single day of the year if you so choose.

    I spoke to Trading Standards just to keep them in the loop and they said I can reject the car if I wanted.

    For my own peace of mind I would rather get a second opinion just in case VW are being over zealous with there report.

    If the MOT highlights the same (or more) faults I will reject. If there are few little items that need sorting I would rather just keep.
    As said it has done a few miles so have to expect some wear and tear.

    Will post results up tomorrow.

    Is 113k miles on a 5 years old car not high?
    I though the average mileage a few years gone was 10k pa, and now around 15k max.
    20+k a year sounds blooming high to me.
    My 2002 Audi has less than 100k on it!

    To me lower mileage is worse than high.
    Most low milers don't get serviced as regularly and are usually stop/start in traffic.
    Most higher mileage cars have been sat in 5th/6th gear on motorway just ticking over.

    It says an upper medium diesels average is over 18k a year

    For examples:

    I had a low mileage Corrado VR6 with 50k (10 years old) and the engine crank snapped. My dad had a Mercedes E200 30k (9 years) that he had from new was scrapped by Mercedes due to electrical problems and a friend of mine had an 11 year A8 2.8 26k (again had from new) and the tiptronic gearbox died.

    Yet 3 of my previous Passat TDI's had over 150k when I sold them and worked perfectly.

    These are just my experiences and I have had a lot more cars that are average mileage that have been fine.
    My point is low isn't always a good thing.

    Took the car for MOT today and it failed.

    Refusal of MOT Certificate:

    NSR tyre below 1.6mm
    OSF tyre below 1.6mm
    OSF Shock absorber serious fluid leak
    OSR Shock absorber serious fluid leak
    NSF CV joint gaiter damaged

    So not quite as bad as VW said but still not fit to be on the road.

    No answer from dealer so emailed a copy of the failure form so he can view for himself.

    Bear in mind that an MOT certificate is not proof that the vehicle is roadworthy, only that it was roadworthy on the day of the test. (Apologies if this has already been said).

    Basic MOT fail stuff and easily to a greater or lesser extent spotted...why didn't you? and why did you not request a '12 month MOT'?....which I suggest most people would have?

    I think you are missing the point.

    You may think I am stupid for buying it but the point is I have not broken the law. According to Trading Standards, the dealer has.

    Errr... there are three points here.. missed or not...
    1) the dealer has broken the law, as you say.
    2) you bought a defective vehicle.
    3) you drove an unroadworthy vehicle.

    Please let us not pretend that the dealer is the only one to have made a mistake, or to have broken the law.
