Sold Car not fit for road?

    Cheers for the replies.

    The easiest scenario is probably a refund but the car drives very well and in the end if it is legal I think I would just prefer to keep it.

    If I let the dealer collect and rectify where would I stand if he did put sub standard parts on it e.g. 2nd hand?

    Can I insist on new parts?

    I don't expect new Pirelli/Michelin tyres but a branded make that I have at least heard eg Falken/Hankook etc.

    The shocks according too VW are both drivers side (front and rear).
    Now I have always been told you should replace in pairs e.g. both fronts if one is faulty.

    Can I insist on all 4 shocks be replaced?
    Now again I don't expect VW shocks @£900 but new replacements from say Eurocarparts etc?

    I imagine all they would have to do is bring the car to a point where it is road worthy. IE just beyond the legal requirments. This is bearing in mind you had the opportunity to inspect the condition of the vehicle before purchasing, so as far as betterment is concerned, this is all.

    However, if is it unroadworthy you would have grounds to reject the car outright -- this gives you a slight upperhand as you can negotiate to keep the car for decent part (although not necessarily new).

    Again, the answer would be the same as above. You can expect betterment to the point the car is now road worthy, but not new. Especially since you bought a second hand car and had the opportunity to inspect it.

    Remember though, there is a difference between being extremely worn and being faulty. There's also a difference between being worn to the point the car is unsafe, thus unroadworthy and a point of just being worn over time.



    Without a completely independant report on the vehicle it's hard for anybody to advise you really, as there are so many ifs and buts.

    Ask for all parts to be replaced and a new MOT at the very least. BTW why buy a car with 113 k miles on the clock ?

    OP - have you checked the MOT test history on this vehicle, just to make sure that the vehicle hadn't been put through, and failed, a test before you bought it?

    Because any idiot knows that 113k mileso n the clock isnt a sign of death for a well looked after car - especially one that is fairly new and not a cheapo.

    without seeing the full report and the dealer standing by the fact they would stand up in court and say this car is illegal to be on the road theres not much point commenting especially as someone will just want to shoot to bits whatever they dont agree with to gain themselves browny points
    but to the OP seeing as you are asking for help

    how did you get the car returned to your drive?
    this 1mm on the inside of the treads,if rest of tread over 1.6 then the tyres are legal
    shockers? have they got a wisp of leakage on them?remember they have done 113,000 miles

    trader offered to collect and inspect at their expense what else do you want them to do
    a jig?
    run round the local estate naked?
    fly you to the moon all expenses paid?

    fully prepared and ready to go probably means valeted by the way

    post up a copy of the dealers comments so we can get a full unbiased

    Luckily for me I have friends who own a Mitsubishi L200 with car trailers (kit cars).

    I can only go by what VW have told me. Remember this is not a back street garage but a dealer for one of the biggest car makers in the world. Now don’t get me wrong I am not saying they are right but as of now that is the only opinion I have had.

    On a modern car 113k isn’t classed as high so should still have life in them.

    I don’t think you understand the severity of what VW have told me. I drove a supposedly illegal car 65 miles home then all over the New Year weekend believing I was legal. If as VW say if anything had happened I would have been in serious trouble with the law and a maybe even worse.
    At the very least I could have had 6 points on my clean license. Now that might not mean a lot to you but I have 20 years No Claims and a Clean License and would like to keep it.

    As far as I can see it's just a VW garage against another garage, the car passed an MoT recently so I doubt it is as bad as VW say. Any garage can overplay faults, there is in fact a current thread about a VW garage telling a customer they needed £600 of work done which was a complete lie, that thread is here and was posted yesterday. Until you get an unbiased second opinion or check for yourself you could be trusting the wrong garage.
