Sold Car not fit for road?

As far as I can see it's just a VW garage against another garage, the car passed an MoT recently so I doubt it is as bad as VW say.
It passed it's last MOT 8.5 months ago, so not recently.Until you get an unbiased second opinion or check for yourself you could be trusting the wrong garage.
Who would be unbiased? If I went to kwikfit, ATS a backstreet garage.....Couldn't they tell me the same? or may find different problems.
I have had 6 Passats, 5 Golf's and 2 Corrado's before and used this VW garage for a very long time so assumed I could trust them.0 -

"If you do, if I was you i'd ensure it's kept as amicable as possible. Keep to the facts, state what you want, but don't make mention of courts, points of law ect ect ect otherwise they may decide they want to be awkward afterall making your whole situation much harder to deal with".
Some years ago, I bought a car in similar circumstances although cheaper and with a full MOT. After driving it for a couple of days I noticed at least one thing that it should have failed the MOT on, and a warning light on the dashboard had been covered over (when I drove it at night I could see a faint glow under the tape). :mad: I spoke to them (amicably) and was refunded.0 -

Whilst I agree about the amiability part I see no reason to mention that it is an offence to sell a car that is not roadworthy. This is something any dealer should be aware of anyway.
Because it's likely the dealer already knows this and by making these sorts of comments is just going to get his back up.
The use of the word 'roadworthy' when explaining the problems itself should be sufficient, whichout reminding him its an offence.0 -

The dealer sold it and should know his legal responsibilities
If the dealer knows the OP is now fully aware that it was an offence to sell a unroadworthy car, that in the full knowledge that it was going to be used on the road, then it puts the OP in a stronger position negotiation wise.

It really depends on how the OP wishes to play it he obviously doesn't need to go in shouting and bawling, but a comment to the effect that he has been advised that it is a offence to sell a car in that state cant hurt with a reputable dealer.
I will wait and see what the dealer says tomorrow when he calls me.
Either way I will make him aware that if he does take the car to remedy the 'Unroadworthy' points, I will get the work verified at a mutually independent garage.
I am a member of the AA and he appears to sell AA warranties so I may suggest them as an alternative.0 -
Dealer called me today and has offered £150 for a couple of tyres so I can at least drive it.
I have booked it in for tyres and an MOT for tomorrow, so wish me luck.
I will be keeping the old tyres just incase.0 -
Isn't there an 'earliest date' on the MOT certificate which you can re-test it?0
