I agree with Visidigi that BA are trying to worm out of paying the full compensation that is due to the OP. However, I'm puzzled as to why the OP allowed the cabin crew to take away the bag containing "things i would need in-case of any emergencies on board, such as my baby's medicines" and put it in a place where it was inaccessible during the flight. While I understand that travelling with a baby is difficult surely it would have made sense to take the two pieces of hand luggage and put the things you don't need and are less valuable in the bag that is going to be taken away from you.[/QUO

After numerous checks at heathrow, with a 7 months old baby, 2 accepted hand luggage that have been opened and checked thoroughly ,...surely the last thing i expected was finding no storage for my other bag and then start sorting which should stay or or not (it wasnt even over 7 kgs. but am sure they could have found somewhere nearer if it was in form of handbag but i assume it was securely closed to be among the checked in ones) - they even broke the rules here..:o

It would be helpful if the OP could say what her hand luggage allowance was - one bag or 2.

I wonder what was in the bag she kept in the cabin.
It sounds like most of the important stuff was in the bag placed in the hold.

Was she given a choice of which bag would go in the hold?
Did she tell cabin crew about necessary items in the bag that was taken from her?
Wouldn't one of the bags fit under the seat?

If the bag was put in the hold, shouldn't it have had a bar-code destination tag put on it and the corresponding 'receipt' with the same bar code given to the passenger as proof in case of loss?

I find this very strange from the OP's first post (posted bizarrely on the 'Child Support' board):

It sounds like the OP didn't formally submit a claim for this lost bag.

I had an allowance of 2 hand luggage. The bag that i kept on the cabin was the a hand bag(the type for babies from boots). It had my wallet, juice for the baby, breast milk (which i was made to taste ofcourse ) up to around 2 pampers, nappy changing mat, my make up, phone and charger, passports.... Generally, the weight was probably 4kgs i assume because it was a small hand bag.

If you must know, the other bag had video camera, medicines, pampers, some clothing and the AVENT microwave bottle steamer with all the bottles, toys and reading books.

I dint have chance to choose so they could have taken either. One thing you should know is that when the attendant realized the in-board passenger luggage cabin was full up she took the bag with her to the other section (which was next to ours and i thought she found where to put it. I realized it was placed among the checked-in ones after we had reached our destination.

i wasn't familiar with this site as am still new on it but i just got excited and rushed in to get some sot of solution. Luckily someone understanding advised me to post it here under consumer rights.

I don't know what you mean by ''...on-hold'' because it wasn't. Probably it should have had a bar code if it was checked in but it was hand luggage.

After over an hour of waiting at the luggage belt, it was confirmed that one of my hand luggage was lost. i filled a form at the airport straight away and i was promised they would get in touch with me in case of any news.

Possibly on the grounds that valuables are not covered when placed in the hold (as clearly stated on the BA website).

They may not have had too much to allow each passenger to take allowable hand baggage, simply too much much to allow passengers to take excess hand baggage (ie, more than 1 item per person).

Irrelevent here as BA don't yet charge for hold luggage unless it's overweight or oversize.

You can't know this for sure unless you were there at the time of check in and saw the OP and their bags.
They may not have had both of them with them, or they may have added items such as duty free at a later time.
BA certainly didn't force anyone to try to take excess baggage on to the aircraft. The OP made this choice all on their own.

As I've already stated. If the OP was flying economy then they are limited to 1 bag for carry on purposes (and a small bag for baby items only).
If they failed to abide by this requirement then IMO, it is their fault.[/QUOTE

NOTE; the 2 hand luggage involved;- MINE and the BABY's ONLY (not sure if this is excess....).

Even with all the effort i made to ask my cousin to come along to the air port in case i had excess to take back home.

BA have admitted that they or their baggage handling agency are at fault and have admitted liability by paying out £190 for the bag.

What they haven't paid out for are for the items that they specifically state shouldn't be placed in hold luggage. This is perfectly acceptable and is no different to what your motor, household or travel insurers would do if a policyholder did something that was in breech of their terms and conditions.

BA would have taken one of the OP's bags either in the departure lounge or at the gate, and there would have been nothing to stop the OP from taking a couple of minutes to sort out the important and valuable items and putting them in the bag that they were taking on board. I've seen many passengers who have done this and the airline staff always allow them time to do it.

in addition, if i was told it was being taken among the checked in baggage, i would have had chance on choice

I'm surprised OP wasn't one of the early boarders. Parents with babies and toddlers tend to be among the first to board.

And am not the one who broke the rules here and neither was i late.

Its the Montreal Convention, not the Warsaw Convention.
Interesting - every ticket I've had when I've been flying has also mentioned the Warsaw Convention - see Wikipedia here.

Alternatively, check out a UK Parliament reference in relation to a Bill here.
  • BA website re Infants luggage allowance - "One bag (for items your infant may require during the flight)". Clearly a 7 month old baby doesn't need a camera whilst flying. The camera shouldn't have been there in the first place, although as has been said before by taking the bag, BA effectively accepted a 'duty of care' for the item and should be responsible.

I wonder whether the bag ever got put in the hold or was stored elsewhere during the flight - I'm curious if it was the same person that took it that informed the OP that they would find it with the checked baggage.

Quite surprised the bomb squad weren't called, what with it being an untagged bag and all :rotfl:

Anyone remember the joke in Coronation Street years ago with the gnome being "kidnapped" and photographed aroudn the world? I wonder if the bar is on a similar trip.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride

    A question I asked yesterday:
Was there no room at all for the 2nd bag to go under your seat?

I would have been bloody angry if I'd been led to believe my cabin bag had just been placed somewhere else in the plane cabin (and therefore available to me at any point during the flight) but they'd put it into the hold.

What if it had had emergency medication (epipen, insulin etc) in it?

It might have started out as hand luggage but if it went into the hold it then became hold luggage and I would have thought it should have had a bar-code tag attached to it and you given the receipt.

I think this is a good point, Sleazy.

Maybe it never went into the hold at all and that's why it wasn't on the carousel.

If it was just a bag left in the plane at the end of a flight with no way of identifying the owner maybe that's why they couldn't find it.

    OP:
was this bag clearly labelled with your contact details?
