    Yeah, but the guy that delivers in your area doesn't personally go to the Amazon warehouse, pick it up and take it to your door step does he?

    There's lots of people that handle your item before it reaches you, it's not fair to pick one of them and blame them when you have no idea where in the chain it's been tampered with.

    Surely if the contents of a package have been tampered with and the outside packaging is totally untouched then the places when it could have occurred are very limited in number.

    Maybe, but even then it's still not just Amazon that have handled the item so still not fair to blame them.

    But it IS their responsibility to supply you with a fit-for-purpose product - no one else's, so yes, it IS fair & correct to blame them - regardless of who's at fault.

    Why not?

    If the package was totally sealed when delivered to the OP then the tampering must have occurred before the shipment was handed over to the delivery agent.

    This can then only give a couple of different options. (unless anyone can think of any more).

    1/ The drinks were consumed before Amazon received them, but they failed to notice this either when they received them or when they were packing them up for dispatch.
    Amazon at fault.

    2/ The drinks were fine when received by Amazon and the tempering/drinking happened sometime before they were packed for delivery to the OP.
    Amazon at fault.

    It depends what you mean by 'blame'. If you want Amazon to be liable/responsible for it, then yes, they have a legal obligation to give the buyer what they paid for.

    But if you want to say an Amazon employee was having a walk around the factory and decided to have a swig out of some of the stock before putting the empty bottle back in the box then it's not fair to say that.

    The item may have been like that before it reached Amazon, no one can be sure that employees of Amazon consumed the product which is what the OP claimed.

    Fair point in the context you're referring to - but equally it's unfair of Amazon to be finger point / apologising for - the courier company for the issue when it almost certainly wasn't them - yet I can pretty much guarantee that by now that Amazon will have invoiced them for the cost of replacing the shipment.

    the grounds i had for claiming that it was an amazon employee are that there are reviews for similar products (protein bars by the same company) that have been sent with the plastic shrink wrapping opened and a bar taken.

    You may have already sent the letter, but just my input:
    I appreciate I’d get a refund for this, but it’s still the inconvenience of having to go to the post office on my lunch break to post these back.

    Could you not book a courier to collect and deliver, thus saving your the trip? It''s unlikely to work out any more expensive than Special Deliverty.
    Do your customer support representatives actually read emails or do they look for buzzwords and reply on the basis of them alone?

    I would leave that bit out. I'm not saying you don't have a valid point, but whoever deals with your complaint is likely to be more sympathetic if you stick to the facts alone, rather than making an accusation..

    Items generally have to be returned for a refund, yes and inconvenience but necessary nonetheless.

    The foil isn't normally there to prevent the goods from spoiling, it is there to show tampering.

    Doesn't the product have the returns labels in the packaging so you can just tape the box up, stick the labels on and return them?
