Glad you got it was sorted out, we often slate Axa as their customer service is often poor / very slow, they seemed to move quickly for you.
As I mentioned before, the claim would probably be declined by most other Insurers, fortunately for you, the wording of the policy was very badly written but in your favour. I would not be surprised if Axa change their policy wording in the future.
Waiving the excess was a bonus.
As Axa sorted out your problem fairly quickly and gave you the excess back, it might be worth repaying them with some loyalty.
P.S I recommend you invest in some security for the shed as the thief may return
I am not going to keep anything in the shed of any worth. In fact I am not going to lock it so they do not damage it again. Once again thank you. The outcome has made the whole situation more palatable.:T:mad:0 -

Your insurance cover if for a peril, so if a fire caused this, your insurer generally covers the loss (often for 12 months). In the first instance, I would suggest you speak to you your insurer and ask for their complaint's procedure. Follow that and then if you are not satisfied, tell them you will be contacting the Financial Ombudsman Services.
It did have it in the policy. But unbeknown to me there is a clause in my Lease agreement called 'cessation of rent' where the landlord should stop the rent if the house becomes uninhabitale. The landlord said that i should claim on my insurance as it was my fridge freezer that did the damage.
Direct Line did not inform me that they wouldnt let me claim (due to this clause) until 4.45pm on the Friday before the Jubilee Bank Holiday weekend. Thus giving me no time at all to sort anything else out.
They knew that i rented all along and even the loss adjuster they appointed that came out, failed to inform me that this would be the case even though he looked at my lease.
If i knew that this clause was in my policy, i would of done things differently, but they were the only ones who knew and didnt deem it worthy to mention it to me.
I have complained to the Ombudsmen, not about the clause itself, but the fact that it isnt shown in my policy and the length of time that they took to divulge it as well the general lack of interest or urgency they and their loss adjusters (Cunningham and Lindsay) have shown throughout.
I am still waiting for someone to look into my complaint at Direct Line by their Customer Relations. My complaint was raised with them on the 1st June. Noone as of yet has been allocated to deal with it.
That is why i have gone to FOS.
Would love to be able to talk to their CEO just to show how they deal with long standing customers. :mad:0 -

28 days is a standard time to give the companies time to respond. This just add in your favour as you complain. Did you get the details of the complaints manager and complaints procedure from Cunninghams? I bet not...another for you to add to your list.0 -

I am recovering from a water damage that is covered by the buildings insurer. The Insurer appointed a builder to repair the damage. I have opted that selected works from the scope of works are cash settled at the prices quoted by the Insurer's builders. The Insurer is saying that it is only willing to cash settle at ex-VAT prices - on the grounds that the works being cash settled will not be done. Is this a reasonable offer and reasonable grounds for not paying VAT?0

They won't want to pay VAT if you're not having the work done and thus no VAT would be due. You may find that the Insurer will with hold the Vat element and then give it to you once you present the paid invoices showing the VAT.
Give them a ring and ask them.0 -

You are exactly right. Thats what they say. However, for cash settlement of the flooring (that was part of the contents with the same Insurer), they gave me the VAT, despite the fact that I was getting laminate done by my own contractors. No requirement for VAT receipts was mentioned. Do I not have a "precedent" argment - I am not sure how forceful that would be.0 -
In a word no. If they want the VAT invoice they can request it otherwise they are paying out for a tax that you will just pocket0
