    I'm sure most of the angles regarding how to cope have been covered.

    The upshot of this thread is..firstly, if intending to petition for BR[or, are married/living with someone who is]....do your homework first.


    From the information I can garner, it appears this was not done with any degree of depth.

    Something we are all prone to doing?

    Early pre-BR preparation is something I always advocate....within the rules, of course.

    And I had three vehicles, all road-legal..ie taxed, insured mot's...etc...
    I collated the evidence needed beforehand regarding getting to and from work, doctors, family, etc....by the various means available...and was able to demonstrate unequivocally that one of my cars needed to be exempted...which it was [the biggest one too]........the other two I purchased the OR's interest, both came to but a coupla hundred the pair.

    However, even though I also had/have two 'boxes of bits' [with V5c's]...full descriptions and estimates of value were included within the initial Court papers.... so the OR was able to see first hand what the value of any asset was...or rather, what it was not....and those boxes of bits were ignored completely..not worth the hassle!

    I wasn't lucky...I was 'prepared'.

    and no, the OR didn't help me clear out my garage!


    My suggestion to the OP may be..look at a 12 or more year-old Skoda Felicia...better than a Polo, very cheap to repair/maintain....can be had for under £300 with MoT! Check out ebay for examples?

    And let the OR take the current car!
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......

    Yes, but if the OR were to dispose of the car, they wouldn't get anywhere near the £1000 assumed value, since it would most likely be disposed through an auction sale.

    Judging by the sentiment of the OP over this issue, and their desperation to keep the car (and possibly more "stuff" than reported here), the OR felt that maybe the OP is trying hide something (or economical with the truth), or does not recognise the seriousness of the situation, they have decided to put a lien on the car.

    Hard lesson to learn but maybe you just got to move on.

    A very recent poster, not naming any names, has shown extreme complacency at the system by boasting about the joys of being clear of bankruptcy in a glib tone, and without lament to the debt incurred. This is why the system has to be punishing.

    Aaahhh...I see, the old moralistic tone rearing its ugly head again?


    Bankruptcy is a legal process, whereby an individual's assets are realised, by a Government Official [the Official Receiver] to be divided up proportionally amongst that individual's creditors.....once that individual can no longer meet those debts as they fall due.

    Simple!

    It is nothing more than a legal process.......just like divorce [or are we going to moralise over that issue as well?]

    Of course, if the situation that doubtless leads most individuals to petition bankruptcy is applied at the level of the State [[PFI anyone??] then that's ok?

    Why on earth should anyone who has petitioned for BR feel in any way 'lamentable' about their previous debts?

    I don't see millions of ex-husbands wringing their hands in sorrow over their failed marriages.....do you?


    Bankruptcy is a part of the whole financial environment we live in.

    And it is a sign of the failure of that system to work properly and equitably.

    The BR process is NOT punishing, nor is it meant to be.

    No crime has been committed.....[at least, no more than that which exists when a family is torn apart by divorce?}

    BR is a process for dealing with a situation which cannot be dealt with any other way....so why should it be 'punishing?'

    But like all lawful processes, due regard has to be paid before entering into such a situation, to the rules whereby the process is expedited.

    These rules do not just apply to BR individuals, but to creditors also.

    For your information....there is no more "stuff". I have at no point lied at any point in my posts - why would I. I am quite upset by the tone of some of these comments.

    All I wanted was support and advise from people who really helped me when we were thinking about bankruptcy.

    I think I shan't be coming back to this board. I was after support when I am feeling extremely fragile and I feel that I have been held up against the wall and currently have an apple on my head with you guys holding an arrow.

  • I tried to be as sensitive as possible in my post, the intention being to tactfully point you towards the idea that perhaps you were coming over as having a rather over-developed sense of entitlement in the circumstances, and this may have come over to the OR, particularly the following remark from your previous post:

    I dont see why I should have to when I have a car that I like and has all the bells and whistles I want. Also, the cars number plates ends in SZZ - my nickname is SAZ so even though it isn't - I've always considered it "personalised".

    Sometimes, it can be more helpful in the long term to say what needs to be said, rather than what people want to hear. Apologies if I got it wrong.

    It was more what makeyourdaddyproud said about inferring I had other "stuff" I was hiding or trying to hide. Totally not necessary and not true!

    Me saying about our numberplate was me just trying to make you understand how I'm feeling inside. I am human after all. Also, if I keep the car I have that I am happy with (which if I can find the money to pay for it then I can) then why shouldn't I? If there is a chance I can keep the car I want rather than having to give it to the OR and then buy one that isn't the same spec.

    We did go bankrupt because we were "naughty" as I explained in a previous post and the decision to go bankrupt was not taken lightly.

    I always knew there would be a possiblity that we would lose the car, but I thought that as there was no finance on the car and I used to to get to work would mean we would stand a better chance of keeping it.

    What I didn't realise is that most of the car problems would stem from the fact that the car is in DH's name NOT mine!
