I'm about to petition for BR and need to clarify the issue with cars. In August, my partner bought a second car ostensibly for my use. It is his, invoice from the garage made out to him etc.

Similar thing happened to my hubby with his motorcycle.....he used it for work...his only vehicle....but was off sick for 6 months so put it on SORN...but they took it off him, they picked up the bike and have not been in contact since, even though it was briefly mentioned that he could buy the bike back, which we cant afford to do anyway, they still havn't been in touch!!!
The thing with hubbys vehicle was that he also travelled like you 7 miles each way to work, 5 days a week, with no bus when on his early morning alternate weekly shift.....they just said they were taking it (appears it was because it was on SORN they classed it as not needed and an asset), even though hubby had only just gone back to work and was going to get the bike back on the road.
They told he because i had a car he had to use that, regradless of whether i needed it, they just assumed he could and should use it:mad:

oh also forgot to mention....re nil tax....has anyone ever not had to pay this, hubbys 'reciever man' forgot the name lol said because its such a little amount not to bother with it!!!

BCL - Maybe the crucial fact that he has already gone back to work and not yet put the bike back on the road was one which the OR latched onto. If his need was so great then he would have had to put the bike back on the road before being able to return to work... Sorry, not what you wanted to hear, but I should think that was quite a key bit of information.When I joined, I needed a name. The forum members gave one to me...I am INAN

Me needing it for work and for us to take our daughter to nursery seemingly isn't a reason for us to keep the car.
They didn't mention us having to lose our mobile phones which relieved me. I was worried that as our contracts are £35 a month each they'd say we had to go PAYG. But they didn't.
The only other thing is I'm getting a nil tax code and the money I would pay tax goes to the OR rather than to the inland revenue. Although they can't set it up that the OR gets the money straight from my pay before I see it (like tax). I have to arrange with moonbeavers that I set up a SO for the amount of tax to pay them each month. Very annoying.
My dad is trying to see if he can pull some money out of his pension to buy our car. But we don't know. However we can appeal (like there's any point) or we have 14 days from the receipt of the letter to either pay up or get the car taken away.

i see where you are coming from, and how reciever could have seen it, but the reason it yet wasnt back on the road was purely a phased transition into riding and driving of my car, so for the time being i was taking him, he had a good 6 months off work, with severe depression which lasted a good 8 months, which also included the comunity physciatric nurse visiting, and he was advised not to drive whilst off, then move slowly into getting back on the road, so in reality he did indeed need the bike at a later stage, but looking at it black and white i see the recievers view hence why we just gave in and let it get taken away, my only concern is we have heard absolutly nothing since it was taken (which isnt a problem as not got the funds to buy it back now anyway), just seemed wierd after they kept saying we 'could' buy it back.0
