    I am a new member here, and still trying to navigate all the relevant pages.
    My question is this:
    Is there any existing information about reclaiming charges from bank and credit cards when accounts have been sold on to debt collectors?:confused:

    Good question, One of my debts with Barclaycard was sold to a DCA, but I sent my first letter today directly to Barclaycard. Simply because i'm claiming back 6 yrs and all the charges that occured or most of them came from Barclaycard.

    It'll also be interesting to find out the procedure. I mean what is the DCA added late fees etc are you able to get these back?

    Im pretty sure whether or not if the account has been closed or past over to a DCA you are entitled to you money back.

    I'm sure someone more knowledgable will give you a much better answer

    You need to put your claim direct to the bank or credit card company but be aware that any monies reclaimed will be put towards any debt no matter who now holds the debt. This of course will be all to the good as it will reduce the debt you owe.

    my husband and I are, in the middle of claiming back monnies from Halifax Bank & Credit Card Charges ...

    we are in debt with them (credit cards) for which monthly payment scheme has been set up

    Can Halifax say ''yes you can have the money back BUT you HAVE to use it to reduce your debt with us'' ???

    which is what they are saying to us,

    We are experiencing 'Hardship' i am disabled, my husband is my carer and cannot work as he has to look after me and our 4 children (one of whom is disbled)
    we claim:
    income support/ dla x 2 ..... etc etc

    Can Halifax do this ?

    Effectively yes. Even if they paid it into your bank a/c, they have a right to set-off:

    Hi. I had a Halifax Mastercard which was closed and passed on to
    Blair, Oliver & Scott a long time ago. I phoned them asking for a list of the charges applied. I have received a letter offering me £208.00. I phoned them today asking what the full charges were, they told me they were £400 and they will put this in writing.

    1) I know you always advise to reject the first offer and then they pay the full amount. I'm thinking of doing this, but was wondering what happens if I reject the offer and for some reason they don't pay the full amount. Do I get nothing?

    2) I'm assuming that because the account was closed a while ago and was passed to Blair, Oliver & Scott, that they will pay the money directly to me and not deduct it from the remaining debt as they are nothing to do with it now. Is that right?

    Thanks very much for any help you can give and also for the tips I have already gleaned from your site.

    if you dont accept the offer you will need to continue your claim. i have no personal knowledge of halifax, but the ones ive claimed from (credit cards)have paid up as soon as court action has commenced.

    the chances are they will pay back the debt to themselves even tho its been passed on.

  • Blair Oliver Scott are the fancy name for their inhouse DCA so in effect your debt is still with Halifax. Yes they have a right to pay your charges into your debt.
  • Thanks very much for all your help and advice. (I've just registered myself, popps is my mum's account).

    I'm going to demand the full amount from Halifax. Something I'm thinking about doing is offering the money I get as a settlement on the debt that I still have, to kill two birds with one stone. You never know, they might accept it and then the whole debt is gone for nothing! I will update this thread when I have some more news.

    Started over at CCs and someone pointed me here, so hopefully I've landed in the right place?


    Basically, CapOne owe me about £300 of charges dating back to 2002. I've asked for them, they've agreed them.

    Problem is that they want to send them to Lowell, who they sold the (£500) debt to, as I defaulted in 2003.

    I want them to pay me direct, but they will only agree to knock £300 off the debt owed to Lowell.

    Any ideas if they can do this?

    I don't want to deal with Lowell as I have CCA'd them without success and they're basically cowboys and I don't want them to have any satisfaction!

    Also, 6 years is up, so does anyone know if reclaiming charges is an acknowledgement of a debt. I assume it is, but wondered if anyone actually knows.
