You won't get a full refund of the tax as you'll lose this month plus there's a handling charge for 6 month tax discs and I think they withold this too.
You also need to be the current or last registered keeper.
I'd ring the DVLA and ask their advice before doing anything else.

I paid £500 for the car and i had to pay another £120 for the roadtax for the six months . She said she would refund me the price of the car but not the tax as she did not sell it to me .

I will withold the disc but i do not know how to get an refund without the Log book , i only have the green slip which they want back with the car with the mot ..

I am going today to get it sorted ( hopefully)

she would be liable for your out of pocket expensis i.e the tax and insurance deposit had the car been declaired as "having the clocks changed and higher mileage declaired" your purchase prognosis may have been different this maybe for a small claims court to sort out but the refund for the car should be sorted out today dont hand them the tax disc, they can purchase this from you if they wish, if they say its not thier car and will have to contact the seller get them to do it infront of you, even request to speak to them i bet you they will refuse with an excuse thier not in their away etc etc just confirming more of your suspicions.

if she signed the reciept and took payment SHE AND OR ON BEHALF OF THE GARAGE sold it to you.

again this is where you chould contact your local trading standards BEFORE you contact the garage/person who sold it to you, they will be able to assist you on your rights.
  • I'd get a screen shot of the advert before it gets pulled.

Also, when you get a refund,m tell them that you will send the V5 to her using the same postal service she used to send you the paperwork... :P

Just got back from the garage after being kept waiting for most of the day.

When the seller eventually did turn up (in a brand new Saab ) she was not happy saying that I had wasted her time as she had to turn down several other offers the day before .

It seems like the whole garage was in on it , they spoke openly about the clock being turned back ( replaced ) , their stance was that the car was “sold as is “ so did not have issue an refund.

When I pointed out that the car was sold as is showing 119000 on the clock things got an bit tense with 3 mechanics shouting saying that the mileage was irrelevant as long as the car drove okay .

To cut an long story short I got my money back for the car but they refused the refund the tax ( I have the disc) , to be honest I was happy to come out with anything as they were getting aggressive.

I have kept copies of all the documents including the previous MOTs showing the discrepancies in mileage. Also they did not include all the advisories on the MOT .

I have spoken to the DVLA who said I should send in the tax disc with an covering letter of what has happened and hopefully they will issue an refund.

Thanks for everyone’s advice and help , it really is buyer beware as there are some right sharks out there ready to bite .

Hopefully there will not be an next time ,

It is only an mistake if you do not learn from it .
  • first thing monday, trading standards phone call. tell them the garage sold a vehicle on behalf someone through the buisiness, and tried to sell it sold as seen. this should pick their ears up for a garage visit.

And these type of people will keep being sharks until you report them to Trading Standards.

I've made it easier for you just put your postcode into the page in the link then give them a call - http://www.tradingstandards.gov.uk/advice/index.cfm
    I'm not cynical I'm realistic :p

(If a link I give opens pop ups I won't know I don't use windows)

Jehangir make absolutely clear to dvla that the tax refund should be sent to you as otherwise this seller might get it as the registered keeper if you only taxed it on the new keweper supplement and the new keeper details haven't been forwarded to swansea by this woman

I too would take this as far as you can because its places like this that tar us all

I will definetly be reporting them as i do not think it was the first time they have done it and what they did was not only wrong but could have been dangerous .

I spoke to someone in the trade and he said the reason the MOT certificate did not have all the Advisories is that they may have photocopied with white paper covering up half of the faults which is easy to do with the new certifates .

I will go to the DVLA office in person and try sorting it out as i would hate to lose the 6 month tax.

It has been a very stressful last 3 days but hanks to everyone for their advice and help it has made it is easier , it is much appreciated .
