Well i never thought i would be posting this, but my dad had a letter back, and they have reversed the ticket, as a gesture of good will..So it is worth appeling

You have that very rare thing, an accepted 'appeal' by a PPC which happens on the odd occasion just so they can show the landlord or retailer and/or the BPA that they do - apparently - 'have an appeals procedure'. They have to have a few real ones to show.
Anyway at least your Dad can relax but it is such a scam that a private company should even be allowed to make people fearful like this, for no lawful reason.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

it bloody annoys the hell out of me people complaining about disabled drivers, i have a badge, i get dla full mobility, to look at me you would not think theres a lot wrong, more especially as i drive a pickup, you want my badge fine take it, take the knackered lungs, the smashed back and the enlarged heart that goes with it !!!, if your really nice i will also let you have the hip thats worn that im too young to get replaced, you can also have the arthritis thats on my spine behind my heart, if your really really nice you can have the shopping list of tablets and inhalers as well, you can have my hospital appointments
i would absolutely love to be in a position health wise to hand my blue badge and my mobility back0 -

In the world of parking disabled drivers are just arrogant "I can park where and how i want" types of people0

Sadly I have seen this 'I have a blue badge and can park where I want' attitude, mainly from elderly people in supermarket car parks who will not even consider that a younger disbled person needs to space as well. Or that I might have been collecting my late disabled Mum from the entrance to the shops and she would need me to be parked there. Some saddos drive round looking daggers at ANY other people already parked in 'their' spaces - never mind that all the people parked may well have lawful reason to be there.
Try to tell them that a genuine long-term disabled person doesn't even need a Blue Badge and they would blow a fuse at you I am sure.
Then the able-bodied wife would no doubt stomp off into the store, leaving disabled hubby sitting in the car with HIS blue badge on display the whole time (disabled bay abuse at its worst, but try telling them that!).
Treeboa I am not including you in that example.

Not sure where thats come from but on-street and council car parks do require you to have a blue badge. There's no rules about getting out of the car when parked if you have a badge. As long as you have a badge you can use it as you please. I remember once having multiple people moan at me about a car in a P&D bay 24/7 telling me it couldn't park there, i should give it a ticket etc. Fact is it is/was allowed and there was nothing we could do or even wanted to do. It wasn't parked in a busy spot and it wasn't causing a problem. The owner had every right to park there.
Disabled badges will always be a hot topic for debate in the world of parking and thats never going to change. What does need to change peoples attitudes. There are a lot of badge abusers who give the rest a bad name who are using their badge correctly. Likewise there are a lot of busy bodys who need to accept that its not down to them to police the blue badge usage.0 -
Tricky Wicky you are replying in 'Council CEO mode'. I was talking about private car parks and no, they CANNOT lawfully restrict their disabled bays to Blue Badge holders only (even though 90% of supermarket signs say exactly that!).
On private land, disabled bays are provided as a reasonable adjustment under the Equality Act 2010 - an Act which clearly gives the definition of disability.
It is effectively defined as a long term ongoing disability which adversely affects everyday life, and the person is covered by that law from the very moment of diagnosis. So someone who has just been diagnosed with ME or cancer etc. CAN stop off at the supermaket and park in one of their 'disabled bays' if they need it. Never mind a Blue Badge, never mind the fake PCN they might attract, never mind the glares from some sections of the elderly disabled population.
I also think I have read an adjudication where a disabled passenger sat in the car while the able bodied person shopped and it was seen by the Council (rightly) as abuse of a disabled bay. As you know, to use a Blue Badge the purpose of the outing has to be for the disabled person and if the driver stops in a disabled bay to grab a bit of shopping for themself - and they choose that bay just because they can, because they have their disabled Mum with them - that is abuse.PRIVATE 'PCN'? Thats true however if you're going to talk about private car parks you should say so. Otherwise some people may think the same applies in public parking places too.

A very interesting point actually however I'd be interested to see this taken to an adjudication for a council PCN. As mentioned above I don't really take PPC car parks and their rules seriously although I did upset plenty of non-disabled drivers last year at a PPC I was working for. They didn't want PCNs issued as they were keeping the client sweet and they hired me as a marshall just to keep things moving and clear. I was literally armed with my mouth - "Move your car, it's not allowed here" for a supermarket. One of the most testing times ever but I did it and all without evening threatening a PCN (which I couldn't issue anyway).

Abuse in that regard is always open to debate. You can drop off a disabled person in the town and then park their car in a disabled space and get a ticket yet if you park in the car park they can't walk far enough to go to the shops. Each council has a different approach to the use of the badge, some are very strict while others are so lenient that you find yourself wanting to hit your head against a brick wall. My last one was heistant to even enforce the 3 hour clock limit although that didn't stop me enforcing it (although my colleagues never bothered). Why? - Another disabled driver may need a turn to park. The never took them as far as adjudication though.0
