If they persisted and did do court, you just conterclaim for Direct Discrimination contrary to the Equalities Act 2010, in that their unenforceable invoice was a "Failure to make a reasonable adjustment" they cannot then say that the didn't know there wasn't a disabled person in the motor; the BB although wrongly displayed is prima-facie evidence of this.
The badge being wrongly displayed is not an issue as it doesn't apply on private land.
Best policy is as always ignore0 -

Not necessarily, if HE has written enclosing a copy of his Blue badge. They may just use his address now and save themseves the DVLA fee. In fact they should use his addy now they know it, as in writing to them he will have also admitted that he was driving...

RE the last post, my dad has written a letter, as he is over 70 and thinks he's doing the right thing, i couldn't talk him out of it. He has stated that i was taking him shopping, as he only has one leg he wouldn't have been driving, so i don't understand the bit about admitted he was driving ?

Sorry, my wrong assumption (as one-legged people can and do drive automatic/adapted cars) but it's possible the PPC will assume the same as me, as he was the one to write to them. A passenger does not often appeal to a PPC and they never read letters anyway, they just look for an address to send their rubbish 'appeal declined' letter to. But which address did he give - if it was his then they may just direct all their threatograms to that address rather than the DVLA-held keeper's address.
If so, how are you going to convince him to ignore the letters? Has he seen the Watchdog clip where it's made clear what to do with these scamograms?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The problem is if your dad gets the usual "Appeal unsuccessful" letter he will have to choose then between ignoring them or fall for the scam! These companies are well versed in overstating their powers and can be very intimidating.
Their appeals process is only there to adhere to the BPA COP and to try and gain information from people. Hopefully your dad will be lucky and they will cancel it.0
