I hope you got the IMEI number before you sent it off

What use would that be? None as paypal will refund if it's returned no matter the IMEI.

Because the police and O2 would need it to investigate and/or bar the phone

well if paypal refund and you have a different phone then you have the buyers addres, inform the police and o2 as stated before.

they wil bar the phone, so therefore the buyer has his money and a dummy phone as it will not work, also a possible call from the police on a fraud charge.

Well..it happened, woke this morning to find buyer has filed a claim as 'This item doesn't match the description in your listing'

It really annoys me i have a feedback score of over 400 and 100%.....and some dodgy individual is obviously pulling a fast one....for what reason i dont know.

It does seem in my experience the seller very rarely comes out on top.....

I told them to goto an Apple store as apple advised me they would replace with a new handset, but they went to O2!!?? They obviously not interested. I have asked them to confirm the IMEI number and serial number of the phone so i can cross reference with my reciept and so if i receive a different one back I have the details proving so.

Playing devils advocate, how do you know he's trying to pull a fast one? Sometimes things just don't work out of the box.

As for Apple giving him a new handset, as I said above this will most likely be a new, refurbished hand set.

But it did work out the box, i tested it before i sent it.

And why ignore advice that is sound and will resolve the matter?

Apple confirmed it would be a new, not refurbished handset.

I'm not saying he isn't up to no good but if I had bought it I would want to return it as the nearest Apple store is a half hour train ride away.

Never used is what you said. What does tested mean?
You may have sold a phone which needs a firmware upgrade, but you reply with "no idea".
I sell plenty of phones, but make sure every one is fully working and running the latest software.
You're not being scasmmed. You are being treated as an indiffernet seller, and rightly so.

    Hi,

Will try and keep this very brief, on the 17th I sold my unwanted iPhone 4s (it was a free upgrade), I only opened to check contents etc...so basically never used.

It was bought as a 'but it now' for £490, the buyer paid within a couple of hours via paypal, so was happy with that, i did notice he had a feedback score of 1 as a buyer, it was a positive but the comments negative (basically, won auction never paid) I thought nothing of it as i got paid.

I sent the item special delivery to the address they had on ebay and paypal and still have the reciept for this etc. I tracked it online and it was signed for on the 19th. I sent a few messages via ebay to ask if recieved to make sure and leave feedback....heard nothing till yesterday.

They sent a message via ebay saying it keeps freezing and wont connect to itunes, and if i had any idea what might be the problem...i replied saying it was never used and as such had no idea.

I entered the serial number on the apple support site and of course its still covered under the warranty, i even called apple to clarify and told me to book appointment with an apple store.

Which is it? Twice in your OP you claim the phone was never used but now you say you tested it?

It's not Apples problem to solve, it's yours and unfortunately you have to accept the return.

When the phone was released and sold only 5.0 was available, hence now 10 days later informing him to check via itunes for latest firmware.

So your statement about checking does not apply, i have owned iphones since the original....i know how the apple system works in that respect.

Besides...who waits 10 days to report a fault on an item purchased, either on ebay or with any seller for that matter.

As for 'testing' and 'never used'....i made a few calls to check it worked with my current O2 sim it connected and worked as did all other functions.
