    It is by no means a small company:

    It doesn't matter. They promised the service, charged the customer accordingly and didn't fulfill their obligations.

    No it does not. Small companies are often just as capable of great service as large ones. Also, expecting next day delivery when that is exactly what the site promises on the order page, isn't exactly an unreasonable expectation.

    It sounds like the webdesign needs some work -I order plenty of flowers online and all the sites I use won't allow me to select a delivery date if the cut off for processing that order had gone.

    Did a test checkout and NO WHERE on the order form does it state order before 3pm.

    burying the 3pm cut off in the terms is VERY poor - and I would be significant miffed (although I wouldnt have ordered from them)

    I am so pleased you can see my dilemma with this by checking out the site for yourself.

    They are taking money from customers like me under false pretences and probably making a mint out of it.

    I'll bite.

    They provided the goods, they didn't provide the service so the OP is entitled to a refund of the service charge.

    Why do they have the right to get a refund for the flowers? They are not covered by DSR, and they are fit for purpose.
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    Don't think the did their T&Cs are quite clear:-

    You may also choose courier delivery for an additional £5.50(see normal delivery schedule below) Normal Delivery Schedule-Courier Deliveries Monday to Thursday: all orders must be placed by 3.00 pm British Standard Time to ensure next working day delivery. Orders placed after 3.00 pm on Thursday will be processed on Friday for delivery on Monday. Orders placed after 3.00 pm on Friday will be processed on Monday for delivery on Tuesday. Delivery Days are Monday to Friday.

    Looks like a smallish company to me. Plus they are in Kilsyth and doubt they have the staff packing flowers at 9pm at night you then need to have clout (ie turnover) to get couriers to collect late at night.

    The OP didn't read the T&Cs and since the company has ismissed the claim and are not willing to offer any goodwil then there is nothing the OP can do.

    Even a small claims case would unlikely succeed in my view.

    But hey ho I'm not saying what the OP wants to hear so my view is unhelpful.
  • I agree that, since they weren't able to offer the next day service, they OP should be refunded that part (and in real money, not in a discount towards some subsequent purchase which may never happen).

    As to whether you should get a refund of the actual goods depends. For instance, if they were to be delivered for a funeral, then they are no good arriving the day after and are therefore useless. In general, though, I wouldn't think it reasonable to get a full refund.
