nevermind the cut off, if the website offers the day as a delivery on the order then this implies delivery on that date is possible.

It sounds like the webdesign needs some work -I order plenty of flowers online and all the sites I use won't allow me to select a delivery date if the cut off for processing that order had gone.

man I just checked out the website after that post - its horrific!

when you checkout it offers you a field to fill in a promotional code with (FLOWER) after it - type flower int he box and it takes off 10%! go figure!

Did a test checkout and NO WHERE on the order form does it state order before 3pm.

On the front page of the site it says this:

We deliver flowers throughout the UK on a daily basis covering all corners of the UK. Our free flowers delivery service uses royal mail to post flowers online and ensures your flowers are delivered fresh and on time. Our dedicated courier flower delivery service offers an extra guarantee that your floral gift is delivered fast by next day or a specific day you choose. Shop for flowers online with British Bouquets and receive the best flower delivery service available in the UK.

burying the 3pm cut off in the terms is VERY poor - and I would be significant miffed (although I wouldnt have ordered from them)

Guaranteed delivery date of 18/11/11 is just the option you chose, if it says elsewhere the cut off is 3pm then you shouldn't have chosen that option because it isn't valid IMO. The website could be better but you could have taken your time and noticed the cut off time. You were obviously in a manic rush to order the flowers because you'd left it to the last minute and couldn't.

When you say you want a refund, I take it you mean of the extra delivery charge rather than the whole order?

    So, what do you think...

    Shipping Speed:
    Guaranteed Delivery Date
    18/11/11

    ...actually means then?

I was not in a manic rush, but I was stupid enough not to double check that time again.. yes that is my fault and as stated from the beginning I dont have much of a problem with that..

Yes I do only mean the delivery charge and not the full amount..

But you would be entitled to the full amount to be refunded.

Entitled to a FULL refund? Goods were shipped and received, just not on the date stated. So whilst the contract was not completed as originally requested, the seller has completed the contract per their T&Cs. (Assuming they don't include weekend deliveries).

Honestly - I'd be interested in your reasoning for a full refund. :)

The transaction did not conform to contract.

So the consumer should accordingly return the goods?

I get where you're coming from, but I don't think it's as cut and dried as you infer.

I thought this is what the interflora set up was for. To enable local flowershops to deliver at short notice.

Expecting next day delivery at 9pm from what I imagine is a small company just defies belief.
