It is your responsibility to verify that your mailbox is in proper working order and you must assume the risk of all consequences for transmission or operational failures.
That is their Terms & Conditions regarding ordering items from the Shop.
Clearly, when you submitted the order you actually made an offer for the phone, which they could refuse or accept. Also, it says that if they accept your order, they will send you a confirmation email.
So, if you got a confirmation email, they have accepted your offer of £0.00 and now entered into a contract to supply the phone.
Don't give up, keep fighting them and they have to supply the phone. Or be sued for breach of contract, plus the adverse publicity.
The fact that their system is not robust enough to cater for this sort of "error" is not the customer's problem....after all, you are only submitting an offer to purchase, which O2 can accept or decline.0 -
Right....just had long phone conversation with some drone from O2.
Basically, they have been briefed (that is call centre staff) that O2's legal team have looked at the position and decided that they are not going to honour the contracts "because the T & C's cover them".
So i asked where in the T&C's they are referring to and she say "in the payment section it says until we take payment the contract isn't made"....A BLATANT LIE!!!!
When i challenged her over this, quoting the T&C's word for word from the website, she went all quiet.
The upshot is that i got her to admit that she had no idea what part of the T&C's allow them to do this, and that they had only been told to refuse to honour the orders because the legal team said so. She couldn't even give me a name in the legal team to speak to!! She did give me the name of a manager supposedly dealing with the matter at a higher level.
Next stop...letter to this manager to see if he knows where in the T&C's it allows them to back out of the contract!!0 -

to be honest with you, we all knew that when all of this started that none of us would get something like a phone for nothing!:rolleyes:
i just think that it was worth a go and now we should just forget about it!
