    The bank isn't responsible in the slightest, it's been explained that you are responsible for the error.

    However, if (my turn to use that word!) you know their identity and have categorically been told that the money has been withdrawn and spent, the situation is straightforward. You go right to the police, as it's a matter of theft.

    There's a possibility that the mother was bluffing and that, if you told her you would go to the police, the money might be paid back to your account. It might be worth a try first.

    Don't think thats the case - certainly not my experiance.

    You may well have an extra hoop to jump through to confirm the first payment to a new payee on your online banking but that doesn'tr effect the payment once it has been confirmed.

    YMMV though.

    So, you know the recipient to whom you have sent £9k+ (although the amount is irelevant), somebody you have previously purchased from. You have tried to contact them without success, well with success as you say their mother has contacted you by phone to say they have spent a £9K windfall from an unexpected source.

    Mmm...

    You know who "they" are, "they" know who you are.

    In which case inform them in writing of your mistake - request repayment within a given number of days or you will inform the police of the theft.

    "If" ? You mean they have ?

    What have the banks got to do with it - why would they give you a small amount back ? Your bank fulfilled your payment request, the receiving bank has nothing to do with it.

    Is it me though or is there a whiff of a farmyard on the breeze ?

  • The wrong Beneficiary's bank has returned an amount to me that was used by the beneficiary to pay off her overdraft with them. Done deal as i got it todayl!! this is why l am thinking that the bank is excepting some sort of responsibility.
    Have already contacted the police, NO IF'S. I think it is theft so do the police. But am unsure if l will be able to get any money back.
    I am not sure that the beneficiary knows who l am as i brought some goods from her way back in july via a web site. She only has my telephone number as l left details of my contact number on her mobile while trying to contact her as she refused to pick up her telephone

    YES everyone, You are right l did make the mistake but we all make mistakes in life. I have a young daughter and was busy and stressed .. and the error in account numbers and names happened.
    This was just one that cost me 10,000 pounds and it has had a profound effect on not only me but my family. I feel absolutly crap and a complete idiot.
    I have found out that actually this kind of thing happens everyday.
    I still feel there should be some sort of 'safety net' regarding sending money where all the details including beneficiary's name match.
    non of this is b***s**t it is happening and consuming my life!!
    Many thanks for all posts I feel at least l am not going mentally over and over it all, trying to find a gap for me to get my money back.

    unsure of what you are saying ,about money Laundering? the mistaken Beneficiary is saying she expected a sum into her account as she had applied for a lone some months prior and thought it was this money.
  • Am thinking maybe the wrong beneificary's bank has returned the money used to pay off an overdraft because this money was stolen ( from me ) and thus they would be dealing in stolen money?? could this be right??

    As far as the bank is concerned, you sent the money as a gift or to people someone you owe money to (eg. rent). It is not stolen. The police will not do anything. You sent the money, it was not taken from you.

    The safety net is that you are asked to confirm your transaction before clicking "Next". You need to make sure the account number/etc is correct at this stage. So in effect you are able to confirm the transaction twice.

    the money was transfered in my error to the wrong person. This person knows it is not their money. they have removed it from their bank account. Banks and police all think this is theft. Police dealing with it. The person's bank has already given me a sum back. I am just unsure of what happens next. If you find money in your bank account that is not yours and you send it. This is theft.
