Letter from Police re non-existent accident!

    Has he made a claim against you on your insurance? You would have thought he would have done that rather than contact the police.

    I would suggest that there advice will be along the lines of:

    1. Acknowledge receipt of the letter and that you have no comments to make.

    2. IF the "case" is investigated insist that any "chats" / "conversations" / "inquiries" / any other description used only take place at the police station with your solicitor present.

    The police currently have no evidence if you write anything descriptive then they now have evidence that can be investigated. Hopefully it will all just be dropped as by sending the letter the police can say that they have followed it up.

    The police attempt to establish 3 things from 4 questions.

    That you were there

    That you were involved

    That you either Deny or admit the allegation..


    Without these 3 things they really dont have a lot to go on.

    Hi there, I have a copy of the letter in front of me (Have the original in envelope ready for posting which had some sections on the back I had to complete) - the bottom of the letter reads 'If you dispute these allegations, have no knowledge or wish to provide mitigating circumstances please provide a written explanation using additional sheets if necessary. It goes on to say that such explanations cannot be taken over the phone, and that the incident cannot be duscussed until written explanation received and the case reviewed. Failure to respond will result in the case being allocated for investigation etc.
    Does the letter contain the allegations made against you and a reference to S172 or S112 of the Road Traffic Act?

    If it does, the minimum you MUST do is respond with the driver's details within 28 days of the date you received the request.

    Failure to do so will render you liable to a further charge of failing to furnish driver details. This carries a heavy fine and 6 penalty points.

    I realise it's difficult to keep schtum when you're faced with a false allegation. The first instinct is to want to put across your side of the story. I'm not suggesting you don't do that, I'm simply suggesting not to do it NOW.

    I really cannot advise you more strongly to join the site I linked to earlier. It will cost you nothing and you will get some of the best guidance available on the net.

    If you haven't already done so, it may be a good idea to come over there and search using parameters like "careless driving, failing to stop, failing to report" and you will be able to see what has been suggested to others in a similar position to you.

  • Reply to the 172 six points and a fine of about £500 if you don't.

    There is no evidence as to who was driving your car at this stage. By naming yourself you will provide that evidence, but you have no option. Then do nothing they will either have enough evidence to summons you for an offence or they won't. I'd sugget they won't and the matter will be filed.
